The purpose of this article is to supersede Subsection 1 of § 271,
Article 16, of the Town Law of the State of New York in its application to
the Town of Cornwall with respect to the length of the terms of appointment
of members of the Planning Board of the Town of Cornwall. The Town Board has
determined, in order to increase participation of citizens in the planning
process and to promote the public health, safety and welfare of the town,
to change the term of appointment for members of the Planning Board as provided
in § 271 of the Town Law. Section 271 of the Town Law remains applicable
to the Town of Cornwall in all other respects.
Upon the expiration of the term of each current member of the Town of
Cornwall Planning Board in office on the effective date of this
article, the reappointment or the successor appointments, as the case may
be, shall be for terms of five years. If a position on the Planning Board
is vacant by expiration of a term on the effective date of this article, the
member previously holding that position shall be reappointed or the successor
appointed for a term expiring five years from the prior date of expiration
of said member's term. Thereafter, upon the expiration of the term of
each member, the reappointment or the appointment of a successor shall be
for a term of five years.
If a vacancy occurs otherwise than by expiration of a term, the vacancy
shall be filled by the Town Board by appointment for the unexpired term.
