The Town Board of the Town of Cornwall has determined that during the
evening hours there are large numbers of people attending meetings, judicial
functions, using the library and transacting town business at Town Hall, 183
Main Street, Cornwall, New York, as well as an increasing number of people
using the town recreation facilities located adjacent to the Town Hall building.
This increase in activity at Town Hall has resulted in a parking problem so
that there is not always adequate parking available for those persons because
many of the parking spaces are occupied by vehicles whose drivers are not
participating in any of the foregoing activities at the Town Hall or the adjacent
grounds. The Town Board has determined that the hours of peak participation
in those activities are between 7:00 p.m. and 11:00 p.m., Monday through Sunday
evenings inclusive. Based upon those legislative findings and determinations,
the Town Board enacts this chapter.
As used in this chapter, the following terms shall have the meanings
indicated:
TOWN
The Town of Cornwall, Orange County, New York.
TOWN BOARD
The Town Board of the Town of Cornwall, Orange County, New York.
TOWN HALL
The Cornwall Town Hall, 183 Main Street, Cornwall, Orange County,
New York.
TOWN HALL PARKING LOT
The Town Hall parking lot at the Town Hall, 183 Main Street, Cornwall,
Orange County, New York.
No motor vehicle shall be parked at the Town Hall parking lot between
the hours of 7:00 p.m. and 11:00 p.m., Monday through Sunday evenings inclusive,
unless the driver and/or the passengers are at Town Hall to participate in
an official town activity as hereinafter defined. An official town activity
shall include one or more of the following activities taking
place either within Town Hall or at the Town Hall recreation facilities adjacent
to Town Hall: meetings of all official boards or bodies of the Town of Cornwall
or any other meeting held at Town Hall with permission of the Town Board;
use of the Cornwall Public Library; attendance at Town of Cornwall Justice
Court; meeting with any government official; use of the town recreation facilities
adjacent to Town Hall, limited to the basketball court, the tennis courts
and the swimming pool.
The driver of any motor vehicle parked in violation of this chapter
shall be guilty of an offense. Any person convicted of a violation of this
chapter shall pay as a fine $50 for the first violation, $100 for the second
violation within a six-month period, $150 for a third violation within a one-year
period and $150 for each subsequent violation within an eighteen-month period.
