As used in this article, the following terms
shall have the meanings indicated:
AT LARGE (OR RUNNING AT LARGE)
A dog shall be deemed to be "at large" or "running at large"
if it is elsewhere than on the premises of the owner while not in
the control of the owner or the owner's agent and without the consent
or approval of the owner of such lands.

Any dog found at large in any street, sidewalk,
lane or public place, including private property other than the dog
owner's property, and not under any effective restraint by chain or
leash as aforesaid may be seized by any duly appointed Dog Control
Officer, peace officer or duly authorized officer or representative
of the town and confined and impounded in the public pound maintained
by the Town of North Hempstead or by any duly appointed Dog Control
Officer, peace officer, duly authorized officer or representative
of the Incorporated Village of Flower Hill and confined and impounded
in any pound within a twenty-mile radius of the Village Hall other
than the public pound maintained by the Town of North Hempstead, in
the County of Nassau. Any dog so found not under effective restraint,
as aforesaid, that cannot be safely seized may be destroyed by such
Dog Control Officer, peace officer or duly authorized officer. Any
duly appointed Dog Control Officer, peace officer or duly authorized
officer of the Town of North Hempstead or the Incorporated Village
of Flower Hill be and the same is hereby authorized to issue and serve
appearance tickets for any violation of this article of the Code of
the Village of Flower Hill.

Any dog impounded in a pound as provided in §
66-3 hereof shall be confined, maintained, redeemed, made available for adoption or euthanized in accordance with Article 7 of the Agriculture and Markets Law; and the operator of such pound shall fix and determine the fees, charges and penalties to be assessed and imposed in connection with the confinement, redemption, sale or destruction of any such dog.

Except as otherwise provided in § 119 of the Agriculture and Markets Law, any person committing an offense against any provision of this article shall, upon conviction thereof, be punishable as provided in Chapter
1, General Provisions, Article
II, Penalties, of the Code of the Village of Flower Hill.
