A. From time to time, the Mayor and Council of the Borough
of Saddle River shall review the costs of collection of garbage and
other waste from nonresidential users in the Borough of Saddle River
and shall establish, by resolution, a schedule of fees to be charged
to nonresidential users of the scavenger service provided within the
Borough of Saddle River. A copy of said resolution shall be mailed to each nonresidential user within 10
days of its adoption stating the effective date thereof.
B. The Mayor and Council of the Borough of Saddle River,
at its option, may elect not to provide for the collection of garbage
and other wastes from nonresidential users in the Borough of Saddle
River. Such election shall be made at the end of each contract between
the Mayor and Council of the Borough of Saddle River and its qualified
scavenger service and/or qualified solid waste disposal service. Such
election may be done by resolution and a copy of said resolution shall
be mailed to each nonresidential user within 10 days of its adoption,
stating the effective date thereof.

The schedule of fees so adopted by resolution
shall be billed quarterly to both the nonresidential users and the
owners of such property for which the scavenger service is provided
and shall be payable on or before the first day of the third month
of each calendar quarter and shall constitute a lien on the property
or on the premises in which such residential user conducts its business
and shall bear interest at the maximum rate allowed for delinquent
taxes under the laws of the State of New Jersey.

The failure to pay the fee so established shall
be grounds for discontinuing the collection of garbage and other wastes
from a nonresidential user. The Saddle River Board of Health shall
be notified when the collection of garbage is being discontinued.
