The sketch plat shall comply with the design standards set forth in this chapter.
A. 
If the sketch plat is classified and approved as a minor subdivision by an action of the Subdivision Committee, then the sketch plat shall be referred for further action to the Planning Board with the written report of the Subdivision Committee. If the Planning Board also classifies and approves the sketch plat as a minor subdivision and the subdivider has submitted a certificate from the Tax Collector of the Borough stating that all taxes with respect to the lots involved in such minor subdivision have been paid to date, the Secretary shall return the original sketch plat to the subdivider within one week following the meeting of the Planning Board.
B. 
The Planning Board may waive the requirement for a public hearing in the case of a minor subdivision, in which event no further Planning Board approval shall be required.
A. 
If the sketch plat is approved as a minor subdivision, the subdivider shall cause a plat, drawn in compliance with N.J.S.A. 46:23-9.11, to be prepared and seven copies thereof delivered to the Secretary of the Planning Board within 15 days after such approval, together with cash to cover Bergen County filing fees and the cost of one certified copy. The Chairman and Secretary shall affix their signatures, and the Secretary of the Planning Board shall cause the same to be filed with the Bergen County Recording Office, having the second copy certified as filed for the records of the Planning Board.
B. 
In addition, the Secretary shall furnish one copy to each of the following:
(1) 
The Borough Clerk.
(2) 
The Borough Engineer.
(3) 
The Construction Official/Building Inspector.
(4) 
The Tax Assessor.
(5) 
The County Planning Board.
If the sketch plat is classified as a major subdivision, a notation to that effect shall be made on the sketch plat. The plat will be returned to the subdivider for compliance with the requirements of this chapter.
A. 
Following the public hearing and prior to adoption of a resolution of approval or disapproval of a subdivision application, the subdivider may request, and the Planning Board may grant, permission to revise the preliminary plat. The Planning Board may grant a continuance not to exceed 31 days for submission of such revised preliminary plat, provided that the subdivider files a written statement of waiver which releases the Planning Board from the requirement to approve or disapprove the application within the time period established by the laws of the State of New Jersey.
B. 
The Planning Board may act to approve or disapprove such revised preliminary plat without additional hearings, unless it finds that the revised preliminary plat contains provisions substantially affecting parties of interest, which provisions were not previously contained in the preliminary plat.
C. 
If, after the public hearing, the Planning Board acts favorably on a preliminary plat, the Chairman of the Planning Board shall affix his signature to the preliminary plat with a notation that it has received preliminary approval contingent upon conditions to be complied with by the subdivider prior to final approval as set forth in a resolution of the Planning Board granting such preliminary approval. The preliminary plat shall be returned, with a copy of such resolution, to the subdivider for compliance with final approval requirements.
A. 
The final plat shall be submitted through the Clerk or the Deputy Clerk, who shall note thereon the date of receipt, to the Secretary of the Planning Board for final approval within three years from the date of preliminary approval. The Planning Board shall act upon the final plat within the time period established by the laws of the State of New Jersey or within such further time as the subdivider shall agree to.
B. 
One reproducible translucent tracing cloth copy, two cloth prints and at least seven black-on-white prints or such other number as may from time to time be required by the Planning Board, together with four copies of the application form for final approval, shall be submitted through the Clerk or Deputy Clerk to the Secretary of the Planning Board at least two weeks prior to the date of a regular Planning Board meeting.
C. 
At the time of filing, all Borough engineering costs in connection with the development shall be paid if all improvements have been installed. If such improvements have not been installed, then the performance and maintenance bond or bonds shall be posted with the Secretary as required by § 195-11. Unless the preliminary plat is approved without changes, the final plat shall have incorporated all changes or modifications required by the Planning Board.
A. 
The final plat shall be accompanied by a statement by the Engineer that he is in receipt of a map showing all utilities in exact location and elevation, identifying those portions already installed and those to be installed.
B. 
The statement shall also state that the subdivider has installed all improvements in accordance with the requirements of these regulations, paid all engineering, inspection and legal fees and posted with the Secretary of the Board a surety company maintenance bond.
C. 
Notwithstanding anything herein contained to the contrary, the Planning Board may grant final approval where all required improvements have been completed, with the exception of the final wearing surface on the roadways in the subdivision, provided that the subdivider shall post with the Borough Clerk a cash bond in an amount equal to 120% of the estimated cost of installing the final wearing surface, as determined by the Planning Board pursuant to recommendation of the Borough Engineer, the cash bond to be conditioned by agreement with the subdivider to install the final wearing surface within one year from the date of final approval.
A. 
The final plat shall be accompanied by a certificate of the Clerk or the Deputy Clerk which shall certify that all deeds and conveyances for all property which is to be given for or dedicated to public purposes, such as park areas and streets and certifications of title of such properties in the grantor free and clear of all encumbrances, are being held in escrow so that they may be transferred to the Borough at such time as the signatures authorizing final approval are placed on the final plot plan.
B. 
In order to enable the Clerk or Deputy Clerk to so certify, the Planning Board shall, after the approval of the preliminary plat, notify the Clerk or Deputy Clerk of its requirements of the subdivider with respect to deeds, conveyances and certifications, the descriptions and form of which shall be subject to the prior approval of the Engineer and Planning Board Attorney.
A. 
At least seven black-on-white prints of the preliminary plat or such other number as may from time to time be required by the Planning Board, together with four completed application forms for preliminary approval, shall be submitted through the Clerk or the Deputy Clerk to the Secretary of the Planning Board two weeks prior to the Planning Board meeting at which consideration is desired.
B. 
Copies of the preliminary plat shall be forwarded by the Clerk or the Deputy Clerk under direction from the Secretary of the Planning Board 10 days prior to the hearing to the following persons:
(1) 
The County Planning Board.
(2) 
The Borough Engineer.
(3) 
The Secretary of the Board of Health.
(4) 
The Construction Official/Building Inspector.
(5) 
Such other municipal, county or state officials as directed by the Planning Board or required by the laws of the State of New Jersey.
C. 
Two copies of the preliminary plat and a notice of the hearing thereon shall be transmitted by the Secretary of the Planning Board, prior to the hearing, to the Planning Board or, if there is none, then to the governing body of every municipality any part of the boundary of which lies within a distance of 200 feet from any part of the subdivision.
A. 
Upon final approval, copies of the final plat shall be filed by the Planning Board with the following:
(1) 
The Borough Clerk.
(2) 
The Borough Engineer.
(3) 
The Construction Official/Building Inspector.
(4) 
The Tax Assessor.
(5) 
The County Planning Board.
(6) 
The Subdivision Search Officer.
B. 
After approval of the final plat by the Planning Board, the subdivider shall deliver two copies to the Secretary of the Planning Board within 45 days after such approval, together with cash to cover filing fees and the cost of one certified copy. The Secretary of the Planning Board shall cause the same to be filed with the Bergen County Recording Office, having the second copy certified as filed for the records of the Planning Board within 90 days from the date of such approval.
C. 
No final plat shall be accepted for filing by the county recording officer unless it has been duly approved by the Planning Board and signed by the Chairman and Secretary pursuant to N.J.S.A. 40:55D-54.[1]
