[Adopted 7-8-1974 as §§ 7-18 and 7-19 of the 1974 Code]
This Article shall be known and designated as an "Article of the Board of Health to Prevent the Spread of Rabies."
As used in this article, the following terms shall have the meanings indicated:
CATTLE
Cows, bulls, calves, horses, mules, asses, sheep, goats and swine.
FISH
Every part of any marine animal.
POULTRY
Chickens, ducks, geese, turkeys, guinea fowl, pigeons and all other fowl commonly kept, raised and sold for human consumption.
SMALL ANIMALS
Rabbits, minks, cats, dogs, guinea pigs and any other small animals kept or raised for commercial purposes or kept and raised for sale or for the production of meat, fur or wool or kept and raised for exhibition or other purposes or as a source of supply for laboratories; provided, however, that the term "small animals" shall not apply if they total in the aggregate fewer than 10 in number.

A. 
All persons who shall own, keep or harbor a dog within the limits of the Borough, except as specified in Subsection B, shall procure for each such dog and shall cause to be fastened on the collar or harness of such dog a suitable tag indicating that such dog has been inoculated against rabies and indicating the year of such inoculation.
B. 
Any dog which has not attained the age of six months shall not be required to be so inoculated, and any dog may be exempt from the requirement of such inoculation, for a specified period of time, by the Board of Health upon the presentation of a certificate from a duly licensed veterinarian of the State of New Jersey that, because of infirmity or other physical condition, the inoculation of such dog for said period of time is contraindicated.
C. 
Any person who shall own, keep or harbor a dog within the limits of the Borough, except as specified in Subsection B, shall procure for each such dog and shall cause to be fastened on the collar or harness of such dog a suitable tag indicating that such dog has been inoculated against rabies and indicating the year of such inoculation.
Any person who shall be guilty of violating the provisions of this article shall be subject to a penalty of not less than $5 nor more than $500 upon conviction thereof in the Municipal Court of the Borough.
Whenever any person who owns, keeps or harbors any dog within the limits of the Borough, except as specified in § 219-13B, is unable to produce, upon the request of any official of the Borough, the tag referred to in § 219-13C or a certificate signed by a duly licensed veterinarian of the State of New Jersey that such dog has received an inoculation against rabies for the current year, he shall upon notice received from the Board of Health, present such tag or certificate to the Board of Health within two weeks from the mailing of such notice.
A. 
Whenever a dog, cat or other animal is infected or is suspected of being infected with rabies or has been bitten by an animal known or suspected to be infected with rabies, the owner or person in charge of any such animal or every other person having knowledge thereof shall forthwith notify the Board. Such notification shall state where the animal or animals so infected may be found.
B. 
Whenever the Board or any officer thereof has reason to believe or has been notified by the State Department that there is danger that rabies may spread within the jurisdiction of the Board, the Board or Health Officer shall serve a notice, in writing, upon all persons within the jurisdiction of such Board, so far as the same may be known to the Board or to such Health Officer, owning, keeping or having charge of any dog, requiring such person to confine such dog. Any and all other animals may be included in the notice whenever, in the opinion of the Board, such animals shall be so included. In lieu of serving the written notice, notice may be published in the official legal newspaper of the Borough.
A. 
Any animal confined under order of the Board shall not be released until a certificate of release has been issued by the Board.
B. 
The Board or the duly authorized agent of the Board, within its jurisdiction, shall be permitted by the owner or person in charge of a dog, cat or other animal which has attacked or bitten a person to examine the animal at any time, and daily if desired, within a period of 10 days after the animal has attacked or bitten a person, to determine whether the animal shows symptoms of rabies. No person shall refuse, obstruct or interfere with the Board in making such examination.
C. 
The local board, within its jurisdiction, shall serve a notice, in writing, upon the owner or person in charge of a dog, cat or other animal known or suspected to have been bitten by an animal known or suspected of being affected by rabies requiring the owner or person in charge of the animal to kill it or confine it for a period of not less than six months.
