Construction activity performed by construction crews and contractors within the Borough of Pleasant Hills, including but not limited to new construction, home remodeling and demolition work, is hereby limited between the hours of 7:00 a.m. and 6:00 p.m. Monday through Saturday. An exception exists for work performed by the homeowner. Homeowners may perform such work on their own property between the hours of 7:00 a.m. and 8:00 p.m. on any day and are not prohibited from working on Sundays and legal holidays.
A. 
Violations of this article are subject to a fine of $300 for each occurrence. Each violation incurred shall be considered a separate violation for purposes of this article.
B. 
Failure to pay the fine may result in a lien being placed on the property and/or referral to the District Justice for prosecution, including an award of court costs and/or sentence of up to 30 days' imprisonment for failure to pay the fine.

A. 
From and after the date of enactment of this section, it is recognized that certain construction-related activity may not result in a disturbance to the neighbors. An exception may he granted by the Code Enforcement Officer for this type of activity such that this activity may occur during prohibited hours. The request for such an exception should be submitted to the Zoning Officer/Code Enforcement Officer, in writing. These requests are to be submitted prior to the building permit being issued. Exceptions will be granted upon demonstration to the Zoning Officer that the proposed work will not involve hammering, power tools or equipment, earth-moving equipment or any other type of activity which reasonably would result in a disturbance to the neighbors. In the event the Zoning Officer denies the request, an appeal of this determination may be requested by submitting a written request to the Borough Manager for Borough Council to hear the appeal. Any such appeal shall he filed with the Borough Manager within 10 days of the determination of the Zoning Officer.
B. 
The regular monthly meeting of the Borough Council of the Borough of Pleasant Hills is held on the third Monday of each month. Any appeal is to be made in writing and delivered to the Office of the Borough Manager by 12:00 noon on the second Monday of the month to be placed on the agenda for that month's Council meeting. Those appeals submitted after 12:00 noon on the second Monday of the month will be heard at the time of the next month's Council meeting.

All requests for exceptions and the appeal are to define the nature of the work and proposed hours when the work will be completed as well as the estimated date when the project will be finished.
