This chapter shall be known as the "Swimming Pool, Spas and Hot Tubs Ordinance" and shall be deemed presumptively to provide for all matters affecting or relating to the location, design, construction, installation, equipment, maintenance, repair and operation of all swimming pools, spas and hot tubs installed in or on the lot of a one- or two-family dwelling constructed within the Borough of Pleasant Hills, it being necessary and desirable for the protection of the health, safety and welfare of persons and property within the Borough.
As used in this chapter, the following terms shall have the meanings indicated:
ABOVEGROUND/ON-GROUND POOL
See "swimming pool."
BARRIER
A fence, wall, building wall or combination thereof which completely surrounds the swimming pool and obstructs access to the swimming pool.
HOT TUB
See "swimming pool."
IN-GROUND POOL
See "swimming pool."
RESIDENTIAL
That which is situated on the premises of a detached one- or two-family dwelling or a one-family townhouse not more than three stories in height.
SPA, NONPORTABLE
See "swimming pool."
SPA, PORTABLE
A nonpermanent structure intended for recreational bathing, in which all controls, water-heating and water-circulating equipment are an integral part of the product.
SWIMMING POOL
Any structure intended for swimming or recreational bathing that contains water over 24 inches (610 mm) deep. This includes in-ground, aboveground and on-ground swimming pools, hot tubs and spas.
SWIMMING POOL, INDOOR
A swimming pool which is totally contained within a structure and surrounded on all four sides by the walls of the enclosing structure.
SWIMMING POOL, OUTDOOR
Any swimming pool which is not an indoor pool.
The provisions of this chapter shall be applicable to all swimming pools, spas and hot tubs intended for one- or two-family dwelling use. All other swimming pools must be authorized by the Borough Council of the Borough of Pleasant Hills and other authority having jurisdiction of other types of pools.
A. 
Installation or construction permits. No swimming pool, spa or hot tub either permanent or portable shall be installed, enlarged or altered unless a permit shall first have been issued therefor by the Building Code Official of the Borough of Pleasant Hills, and said permit shall be issued only if the requirements of the Department of Health of the County of Allegheny and the requirements of the Pennsylvania Uniform Construction Code are met.[1]

B. 
All applications for in-ground or indoor swimming pools, spas and hot tubs must be accompanied by a plot plan and complete construction drawings prepared by and bearing the seal and signature of the architect or engineer registered in the Commonwealth of Pennsylvania.
C. 
No swimming pool, spa or hot tub permit shall be issued until a certificate of insurance evidencing coverage for possible liability to third persons for bodily injury or property damage in the minimum amount of $100,000 shall be filed with the Borough Building Code Official.
A. 
A survey or plot plan to scale shall be furnished showing all property, main and accessory buildings, driveways, fences, walks, filters and other related equipment thereon. The proposed location of the swimming pool, spa or hot tub shall be clearly shown on this drawing.
B. 
Private swimming pools, spas and hot tubs, except indoor installations, shall be located entirely within the rear yard area and no less than 10 feet from any property line and no closer than eight feet from any building. Pools located on corner lots shall be completely screened by evergreen plantings when viewed from the side street, or a fence as permitted by the fence regulations of the Code of the Borough of Pleasant Hills.
All swimming pools, spas and hot tubs shall conform to the requirements of the Pennsylvania Uniform Construction Code, current edition,[1] as such code relates to barrier requirements.

All swimming pools, spas and hot tubs shall conform to the Pennsylvania Uniform Construction Code, current edition, for all matters relating to design, construction, entrapment protection, suction outlets, suction fittings, vacuum relief systems, drains, cleaner fittings and electrical requirements.

A. 
To prevent stagnant water, every permanent or portable swimming pool shall be of the recirculation type in which circulation of water is maintained through the pool by one or more pumps, the water drawn from the pool or at the place of return by the use of recognized and approved chemicals. In addition, each property owner is responsible to abate hazardous conditions which require remediation. The Zoning Officer or Code Enforcement Officer shall notify the property owner of such conditions. These conditions may include bowed or weakened walls which appear to be in a state of disrepair and in danger of collapsing or stagnant water which has been allowed to accumulate in the swimming pool or on top of the pool cover and result in a nuisance by attracting flying insects or mosquitoes, etc. In the case of such situations, the property owner shall receive notification of the hazard and a reasonable time period to abate the hazard. Notice of the hazard shall be served by hand delivery, certified mail, facsimile or telephone call to the owner.
B. 
In the event that the owner does not abate the hazard within the time established by the notice, the Borough shall have the right to arrange for necessary repairs and/or corrective action. This may include drainage the water from the pool to abate the hazard of collapse or to remove stagnant water. Upon notice of the violation and the failure to abate the violation, the property owner may be subject to a fine of $300 as described in § 326-13 below. In the event the Borough is required to abate the hazard as a result of the failure of the property owner to respond to the notice and correct the hazard, the Borough may charge the property owner the actual cost of labor and/or any materials required to correct the hazard, in addition to the fine.
No water other than that secured from the public waterworks distribution system or private water approved by the Health Department shall be used in any swimming pool, spa or hot tub.
Supply inlets for any swimming pool, spa or hot tub recirculatory system shall be located, to the extent possible, so as to produce a uniform circulation of water throughout the pool and to carry pool bottom deposits toward the outlet or outlets.
A. 
Every permanent swimming pool, spa or hot tub of concrete construction must be equipped with adequate floor drains and valves to regulate flow of wastewater or pool drainage and must be piped into the sanitary sewer system.
B. 
Every vinyl or membrane-lined swimming pool, spa or hot tub must be equipped with sufficient hose or flexible piping to permit drainage by pumping through the sanitary sewer system of the dwelling.
Any means of germicidal or bacterial protection within the pool, spa or hot tub equal or superior to a standard of 0.5 parts per million chlorine residual may be used in permanent or portable swimming pools. Every pool, spa or hot tub shall be equipped with a testing kit adequate to determine such residual.
Any person, firm, corporation, group or association violating any provisions or regulation of this chapter shall, upon conviction thereof before any District Justice, be fined a sum not exceeding $300, and upon any default in payment of said fine, may be committed to imprisonment in the Allegheny County Jail for a period not exceeding 30 days. Each day that a violation is permitted to exist by such person after notice in writing shall constitute an additional, separate offense, punishable by like fine or penalty.
All commercial public or health/member club swimming pools must comply with all state, county and Borough regulations concerning zoning, construction, health and safety matters including Borough Council approval.
