As used in this chapter, the following terms
shall have the meanings indicated:
Enclosure
Any fence or barrier of metal, wood, plastic, brick, stone,
concrete or other construction material or any trees, bushes, shrubs,
hedges or combination thereof which surrounds a swimming pool.
Owner
Any person holding title to the property upon which the pool
is situated or, for the purpose of this chapter, any tenant or other
person in possession of the premises with the permission of the owner.
Swimming Pool
Any body of water greater than 24 inches in depth and having
a plane surface area greater than 30 square feet, installed or maintained
in or above the ground outside any building and used and intended
to be used solely by the owner, tenant or lessee of the premises upon
which the pool is situated and by his family or guests invited to
use it without the payment of any fee.

A. All outdoor swimming pools completed after April 25,
1986, within the Village of Sands Point shall be maintained as follows:
an approved enclosure that complies with the New York State Building
Code at the time of issuance of the certificate of completion.
B. All outdoor swimming pools completed on or before
April 25, 1986, within the Village of Sands Point shall be maintained
as follows: An approved enclosure at least four feet in height shall
be provided around outdoor swimming pools so that such pools are inaccessible
to children. The enclosure may surround either the pool area or the
property.
No building permit for construction of an outdoor
swimming pool shall be issued unless a landscaping plan is filed with
and approved by the Building Department.

Any person violating any of the provisions of
this chapter shall pay a fine of not more than $250 for each offense.
It shall be deemed a new or additional offense for every twenty-four-hour
period during which the condition continues unabated, provided that
a new accusatory instrument is issued.
