A. The construction of private water wells for the purpose of providing
drinking water and domestic water use is forbidden in the Village
of Sands Point.
B. The construction of private water wells for the purpose of providing
water for irrigation systems shall be prohibited unless approved by
the Board of Trustees on the recommendation of the Superintendent
of the Village's Water Department.

The owner, lessee or tenant of any premises where any violation
of this chapter or of the rules and regulations promulgated by the
Board of Trustees pursuant to this chapter has been committed or shall
exist and any person who takes part or assists in such violation or
maintains any premises on which such violation shall exist shall be
liable for and forfeit and pay a penalty of not more than $500 for
each offense, and in addition thereto such conduct shall constitute
and is hereby declared to be disorderly conduct, and any person violating
the same shall be and is hereby declared to be a disorderly person.
Each day that the violation is permitted to exist on any premises
shall constitute a separate offense.

Private water wells constructed prior to the
adoption of Local Law No. 4 of 1987 cannot have a pumping capacity
in excess of 25 gallons per minute.
