This chapter shall provide for the promotion and protection of the health, safety and welfare of the people of the Village of Weedsport by regulating the operation of snowmobiles and all-terrain vehicles within the corporate limits of the Village of Weedsport in a manner which will be compatible with the use of such streets for vehicular and pedestrian travel and other uses and which will promote the safe and proper use of snowmobiles and all-terrain vehicles within the Village of Weedsport.
Local Law No. 4-1970, as amended by Local Law No. 1-1973, regulating the operation of snowmobiles within the Village of Weedsport is hereby repealed in its entirety.
A. 
The terms, words, and phrases used in this chapter shall have the same meaning as such terms, words and phrases are defined in the State of New York Parks, Recreation and Historic Preservation Law and the State of New York Vehicle and Traffic Law.
B. 
In addition, the following terms, words and phrases shall have the following meaning:
ACCOMPANY
To be within a reasonable distance of the person accompanied.
ALL-TERRAIN VEHICLE or ATV
Any self-propelled vehicle which is manufactured for sale for operation primarily on off-highway trails or off-highway competitions and only incidentally operated on public highways, providing that such vehicle does not exceed 60 inches in width or 800 pounds dry weight.
A. 
The use and operation of snowmobile vehicles on sidewalks within the Village of Weedsport is strictly prohibited.
B. 
In case of emergency, and when directed by emergency personnel, a snowmobile may be operated on any portion of the Village highways and sidewalks as directed by said emergency personnel.
C. 
Whenever the operation of a snowmobile vehicle is permitted on the shoulder of any Village street or portion thereof as provided by the State of New York Parks, Recreation and Historic Preservation Law and the State of New York Vehicle and Traffic Law, the following conditions and restrictions are hereby imposed:
(1) 
No snowmobile shall be operated within the Village of Weedsport between the hours of 12:00 midnight and 7:00 a.m.
(2) 
No person under the age of 10 years shall operate a snowmobile within the Village of Weedsport.
(3) 
No person between the ages of 10 years and 18 years shall operate a snowmobile within the Village of Weedsport unless said operator shall possess a New York State safety certificate and shall be accompanied by a parent or legal guardian.
(4) 
No snowmobile shall be left unattended while the motor is running or with the keys left in the ignition or elsewhere in said vehicle.
(5) 
No person shall operate a snowmobile vehicle at a speed in excess of 15 mph.
(6) 
No person shall operate a snowmobile on Village property, except in those areas specifically designated for snowmobile use.
A. 
The use and operation of all-terrain vehicles on streets, sidewalks and public property within the Village of Weedsport is strictly prohibited, except in case of emergency and when directed by emergency personnel. In such cases, all-terrain vehicles shall be operated as directed by said emergency personnel.
B. 
Whenever the operation of an all-terrain vehicle is permitted on private property as provided in the New York Vehicle and Traffic Law, the following conditions and restrictions are hereby imposed:
(1) 
No all-terrain vehicle shall be operated within the Village of Weedsport between the hours of 12:00 midnight and 7:00 a.m.
(2) 
No person under the age of 10 years shall operate an all-terrain vehicle within the Village of Weedsport.
(3) 
No person between the ages of 10 years and 18 years shall operate an all-terrain vehicle within the Village of Weedsport unless said operator shall possess a New York State safety certificate and shall be accompanied by a parent or legal guardian.
(4) 
No all-terrain vehicle shall be left unattended while the motor is running or with the keys left in the ignition or elsewhere in said vehicle.
(5) 
No person shall operate an all-terrain vehicle at a speed in excess of 15 mph.
Any person or entity violating any of the provisions of this chapter shall be guilty of a violation which shall be punishable as provided in Chapter 1, General Provisions, Article I, General Penalty, of the Code of the Village of Weedsport.
