The purpose of this chapter is to provide for the protection, health, safety and welfare of the residents of the Village of Weedsport and others using the roads, streets and highways of the Village of Weedsport by providing for regulations of the use of streets, highways, roads, drives, and boulevards within the Village of Weedsport.
This chapter shall hereafter be known and cited as the "Vehicle and Traffic Law of the Village of Weedsport, New York."
This chapter is adopted pursuant to the authority of the General Municipal Law and the Vehicle and Traffic Law of the State of New York.
The following local law relating to this subject is hereby repealed: Local Law No. 4-1995.
This chapter establishes rules and regulations governing the parking of vehicles and the control of traffic on Village of Weedsport streets and provides penalties for violations of such rules and regulations.
A. 
The words and phrases used in this chapter shall, for the purpose of this chapter, have the meanings respectively ascribed to them by the Vehicle and Traffic Law of the State of New York.
B. 
The following words and phrases which are not defined by the Vehicle and Traffic Law of the State of New York shall have the meanings respectively ascribed to them in this section for purposes of the traffic law of this Village:
(1) 
Holidays. New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and Christmas Day shall be considered holidays.
(2) 
Directions. In view of the fact that the streets of the Village do not run in a true north and south or east and west direction, it is hereby determined that wherever the words "north," "south," "east" and "west" are used in this chapter, they shall be interpreted on the assumption that Seneca Street and all streets running parallel or approximately parallel thereto shall be considered as running north and south and that Brutus Street and all streets running parallel or approximately parallel thereto shall be considered as running east and west.
The Board of Trustees shall have the authority to direct the installation and maintenance of traffic control devices when and as required under the provisions of this chapter.
Thirty miles per hour is hereby established as the maximum speed at which vehicles may proceed within the corporate limits of the Village of Weedsport except on the following highways:
A. 
Erie Drive (NYS Route 31).
(1) 
Thirty-five miles per hour is hereby established as the maximum speed at which vehicles may proceed within the corporate limits of the Village of Weedsport on Erie Drive (NYS Route 31) between a point 600 feet south of its intersection with West Brutus Street and the northerly corporate line of the Village of Weedsport.
(2) 
Forty-five miles per hour is hereby established as the maximum speed at which vehicles may proceed within the corporate limits of the Village of Weedsport on Erie Drive (NYS Route 31) between a point 600 feet south of its intersection with West Brutus Street and the westerly corporate line of the Village of Weedsport.
B. 
Jackson Street.
(1) 
Twenty miles per hour is hereby established as the maximum speed at which vehicles may proceed on Jackson Street between Centennial Street and Franklin Street between the hours of 7:00 a.m. and 5:00 p.m. on days when school is in session.

C. 
East Brutus Street.
(1) 
Twenty miles per hour is hereby established as the maximum speed at which vehicles may proceed on East Brutus Street between Willow Street and the east line of the Village of Weedsport.

A. 
Erie Drive (NYS Route 31) is hereby designated as a through highway.
(1) 
Stop signs shall be erected on the following entrances thereto:
(a) 
Jackson Street, from the south.
(b) 
Watson Street, from the east.
(c) 
Malt Street, from the south.
(d) 
Cottage Park Extension from the east.
(e) 
Hawley Street, from the south.
(f) 
Canal Street, from the west.
(2) 
Yield signs shall be erected on the following entrances thereto:
(a) 
Easterly spur of NYS Route 34 (at northerly Village line) from the south.
(b) 
Westerly spur of NYS Route 34 (at northerly Village line) from the north.
B. 
Seneca Street (NYS Route 34) is hereby designated as a through highway, and stop signs shall be erected on the following entrances thereto:
(1) 
Lincoln Street from the west.
(2) 
VanBuren Street from the east.
(3) 
Washington Street from the west.
(4) 
Hamilton Street from the west.
(5) 
Bell Street from the east.
(6) 
Highland Street from the west.
(7) 
Jefferson Street from the east.
(8) 
Rude Street from the east.
(9) 
Malt Street from the north.
(10) 
Liberty Street from the east.
(11) 
Centennial Street from the east.
(12) 
Cottage Park from the east.
(13)

D. 
South Street is hereby designated as a through street, and stop signs shall be erected on the following entrances thereto:

Bell Street from the west.

Mechanic Street from the west.
(6) 
East Rude Street from the east.

A. 
The intersection of Centennial Street with Jackson Street and James Street is hereby designated as a four-way stop intersection, and four-way stop signs shall be erected on each entrance.
B. 
The intersection of Green Street with Jackson Street is hereby designated as a four-way stop intersection, and four-way stop signs shall be erected on each entrance.
C. 
The intersection of VanBuren Street with Horton Street is hereby designated at a stop intersection, and a stop sign shall be erected on Horton Street at its entrance to said intersection from the south.
D. 
The intersection of Goff Street with Washington Street is hereby designated as a stop intersection, and a stop sign shall be erected on Goff Street at its entrance to said intersection from the south.
E. 
The intersection of Hamilton Street with East Terrace Street is hereby designated as a stop intersection, and a stop sign shall be erected on East Terrace Street at its entrance to the said intersection from the south.
F. 
The intersection of Hamilton Street with Goff Street is hereby designated as a stop intersection, and a stop sign shall be erected on Goff Street at its entrance to the said intersection from the north.
G. 
The intersection of Bell Street and Horton Street is hereby designated as a stop intersection, and stop signs shall be erected on Horton Street at its entrances to said intersection from the east and west.
H. 
The intersection of Horton Street with Mechanic Street is hereby designated as a stop intersection, and a stop sign shall be erected on Mechanic Street at its entrance to said intersection from the east.
I. 
The intersection of Mechanic Street with Graham Street is hereby designated as a stop intersection, and a stop sign shall be erected on Graham Street at its entrance to said intersection from the south.
J. 
The intersection of Jefferson Street with Horton Street is hereby designated as a three-way stop intersection, and all-way stop signs shall be erected on each street entrance.
K. 
The intersection of Horton Street with Rude Street is hereby designated as a stop intersection, and a stop sign shall be erected on Horton Street at its entrance to said intersection from the north.
L. 
The intersection of Rude Street and Graham Street is hereby designated as a stop intersection, and a stop sign shall be erected on Graham Street at its entrance to said intersection from the north.
M. 
The intersection of Hooper Street and Marshall Street is hereby designated a three-way stop intersection, and stop signs shall be erected on Marshall Street at its entrance to said intersection from the west, and Hooper Street from the north and south.
N. 
The intersection of Hooper Street and Sharon Street is hereby designated a stop intersection, and a stop sign shall be erected on Sharon Street at its entrance to said intersection from the west.
O. 
The intersection of Marshall Street and Sharon Street is hereby designated a stop intersection, and a stop sign shall be erected on Sharon Street at its entrance to said intersection from the east.
P. 
The intersection of Hooper Street and Basin Street is hereby designated a stop intersection, and a stop sign shall be erected on Basin Street at its entrance to said intersection from the west.
Q. 
The intersection of Marshall Street and Basin Street is hereby designated a stop intersection, and a stop sign shall be erected on Basin Street at its entrance to said intersection from the east.
R. 
The intersection of Weed Street and Basin Street is hereby designated a stop intersection, and a stop sign shall be erected on Weed Street at its entrance to said intersection from the north.
S. 
The intersection of Weed Street and East Street is hereby designated a stop intersection, and a stop sign shall be erected on Weed Street at its entrance to said intersection from the south.
T. 
The intersection of East Street and South Willow Street is hereby designated a stop intersection, and a stop sign shall be erected on East Street at its entrance to said intersection from the east.
U. 
The intersection of Emy Street and Marshall Street is hereby designated a stop intersection, and a stop sign shall be erected on Emy Street at its entrance to said intersection from the west.
V. 
The intersection of East Street with South Willow Street is hereby designated a stop intersection, and a stop sign shall be erected on East Street at its intersection with South Willow Street from the west.
W. 
The intersection of Oakland Park with Oakland Street is hereby designated a stop intersection, and a stop sign shall be erected on Oakland Street at its entrance to said intersection.
X. 
The intersection of Earl Street with Oakland Street is hereby designated a stop intersection, and a stop sign shall be erected on Earl Street at its entrance to said intersection.
Y. 
Where the westerly portion of Rosewood Circle intersects and rejoins Rosewood Circle in a perpendicular, north-south direction, is hereby designated a stop intersection, and a stop sign shall be erected on Rosewood Circle at its entrance to said intersection.

Z. 
The westernmost intersection of Dorothy Court with Rosewood Circle is hereby designated a stop intersection, and a stop sign shall be erected on Dorothy Court at its entrance to said westernmost intersection.

AA. 
The easternmost intersection of Dorothy Court with Rosewood Circle is hereby designated a stop intersection, and a stop sign shall be erected on Dorothy Court at its entrance to said easternmost intersection.

A. 
Furnace Street is hereby designated for one-way traffic in an easterly direction from its intersection with South Seneca Street towards South Street.
B. 
Canal Street is hereby designated for one-way traffic in a southerly direction from its intersection with West Brutus Street towards Erie Drive.
C. 
Franklin Street at the triangle is hereby designated for one-way traffic going in a southerly direction onto Jackson Street. A yield sign shall be erected at the intersection of the Franklin Street spur and Jackson Street, and "Do Not Enter" signs shall be erected for traffic coming off Jackson Street. They shall go to the T-intersection of Franklin and Jackson Streets to turn.
No pedestrian shall cross any street with the Village of Weedsport except at its intersection with another street, or within marked crosswalks.
The turning of any vehicle on any Village street so as to proceed in the opposite direction is hereby prohibited.
The intersection of Franklin Street with Jackson Street is hereby designated a yield intersection, and traffic proceeding easterly on Franklin Street shall yield to traffic proceeding on Jackson Street.
Except where angle parking is authorized, every vehicle stopped, standing, or parked upon a highway shall be so stopped, standing or parked parallel to the edge of the roadway, headed in the direction of lawful traffic.
No angle parking is permitted within the Village of Weedsport except along the east side of Erie Drive.

A. 
Reserved spaces designated.
(1) 
There shall be one handicapped parking space located on the south side of Franklin Street beginning at a point 20 feet east of the crosswalk on Franklin Street and extending 25 feet easterly along the south line of Franklin Street.
(2) 
The Board of Trustees of the Village of Weedsport may, by resolution, designate such handicapped parking spaces in Village Municipal Parking Lots, as said Board deems appropriate.
A. 
The provisions of this section shall apply except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device.
B. 
The parking of vehicles is hereby prohibited in the Village of Weedsport on the following streets:
(1) 
South side of Furnace Street.
(2) 
On the east side of Jackson Street between East Brutus Street and NYS Route 31. On the east side of Jackson Street from Green Street to James Street, with the exception of the designated dropoff zone, there shall be no stopping or standing.

(3) 
West side of South Seneca Street from intersection of West Watson Street and South Seneca Street to the intersection of Lincoln Street and South Seneca Street.
(4) 
That portion of West Brutus Street between Seneca Street and Erie Drive.
(5) 
The west side of South Street for a distance of 150 feet southerly from the center line of Furnace Street.
(6) 
On the north and south sides of Watson Street between South Seneca Street and Erie Drive.
(7) 
On the north and south sides of Malt Street between Rt. 34 and Rt. 31.
(8) 
On the south side of Lincoln Street from Cool Street to South Seneca Street.

On the east and west sides of Cool Street between Lincoln Street and Washington Street.
(10) 
On the east and west sides of Oakland Street from West Brutus Street to the Village limits.

C. 
The parking of vehicles is hereby prohibited in any of the following locations for a period of longer than four hours at any time between the hours of 6:00 a.m. and 6:00 p.m., except on Sundays and holidays:
(1) 
The east or west side of North Seneca Street from Brutus Street to Green Street.
(2) 
The east or west side of South Seneca Street from Brutus Street to Liberty Street.
(3) 
The south side of East Brutus Street between Seneca Street and South Street.
D. 
The parking or standing of vehicles in the following areas is prohibited:
(1) 
The west side of Erie Drive (Rt. 31) for a distance of 275 feet north from the intersection of Erie Drive and West Brutus Street.
(2) 
The west side of Erie Drive (Rt. 31) for a distance of 100 feet south of the intersection of Erie Drive and West Brutus Street.
(3) 
The east side of Erie Drive (Rt. 31) for a distance of 100 feet north of the intersection of Erie Drive and West Brutus Street.
(4) 
The east side of Erie Drive (Rt. 31) for a distance of 100 feet south of the intersection of Erie Drive and West Brutus Street.
(5) 
The south side of East Brutus Street for a distance of 30 feet west of the intersection of East Brutus Street and South Street.

E. 
The parking of vehicles is hereby prohibited in any of the following locations for a period of longer than two hours between the hours of 6:00 a.m. and 6:00 p.m., except on Sundays and holidays: The north side of Furnace Street.
F. 
Municipal parking lots located on Erie Drive (between Brutus Street and Key Bank) and on Furnace Street/East Brutus Street. Daytime parking is limited to eight hours between the hours of 6:00 a.m. and 6:00 p.m. From 6:00 p.m. to 6:00 a.m., parking is limited to no more than 10 hours.
G. 
The parking of vehicles is hereby prohibited on all highways within the Village of Weedsport between the hours of 1:00 a.m. and 6:00 a.m.
A. 
Declaration of emergency. Whenever road conditions in the Village of Weedsport shall become hazardous or such that the free movement of fire, health, police emergency or other vehicular traffic may be impeded by reason of snow, freezing rain, sleet, ice, water, debris, fire or other natural or artificial causes, the Mayor of the Village of Weedsport or such other person designated by him may and he hereby is authorized to declare the existence of an emergency.
B. 
Notice. The declaration of an emergency as aforesaid may be conveyed to the public by radio, television or newspaper, announcement by one local radio station or one television station, or one daily newspaper circulated in the Village of Weedsport. Notice may also be transmitted to the general public by distribution of notices, leaflets, handbills or other written or printed notice distributed to the general public or affixed to automobiles parked on the streets within the Village of Weedsport. If the emergency is obvious, such as a fire, unusually heavy snowfall, or other visible causes which, to a reasonably prudent person, would indicate the existence of an emergency, no additional notice shall be required.
C. 
Duration of notice. The emergency so declared shall be deemed to continue for a period of 72 hours unless earlier terminated by the Mayor of the Village of Weedsport, or the person designated by him in accordance with § 198-18A, hereof, and termination of the emergency may be declared as to one or more emergency streets prior to the seventy-two-hour period or the complete emergency terminated as aforesaid.
D. 
Designated emergency streets.
(1) 
It is ordered and directed that the following named streets in the Village of Weedsport be, and the same hereby are designated as, emergency streets, and appropriate signs shall be erected on said streets:
(a) 
North Seneca Street from Brutus Street to the Village line.
(b) 
South Seneca Street from Brutus Street to the Village line.
(c) 
Brutus Street from the east Village line to the west Village line.
(d) 
Erie Drive from the east Village line to the west Village line.
(e) 
South Street from East Brutus Street to the south Village line.
(f) 
Jackson Street from East Brutus Street to Erie Drive (Rt. 31).
(2) 
Such other streets may be designated as emergency streets by the Mayor of the Village of Weedsport as may, in his discretion, be advisable or necessary to further carry out the provisions and intent of this section.
E. 
Limitations on parking during emergencies. After the declaration of an emergency and the giving of public notice, as aforesaid, or during an emergency when no public notice is required, it shall be unlawful for the owner or driver of a motor vehicle to cause, permit, allow or suffer said vehicle to be parked or to be left unattended on any emergency street during the period of the emergency. Where the driver of said vehicle cannot be located, the violation of this provision shall be presumed to be that of the registered owner of the vehicle.
F. 
Exception. The provisions of § 198-18E shall not apply to physicians on emergency call, emergency vehicles, snow-control vehicles, public vehicles of service, or ambulances on emergency call.
G. 
Removal of vehicles. Any vehicle left unattended as set forth herein, or which shall be stalled or otherwise unable to be moved, on any emergency street during an emergency may be towed or removed or caused to be removed under the direction of the Police Department, and the owner or person in charge of said vehicle shall be subject to the storage changes and/or fines in accordance with § 198-19 of this chapter.
A. 
Authority to impound vehicles.
(1) 
When any vehicle is parked or abandoned on any highway within the Village of Weedsport during a snowstorm, flood, fire, or other public emergency which affects that portion of the Village of Weedsport where said vehicle is parked or abandoned, said vehicle may be removed by any member of the Police Department.
(2) 
When any vehicle is found unattended on any highway within the Village of Weedsport or said vehicle constitutes an obstruction to traffic, said vehicle may be removed by any member of the Police Department.
(3) 
When any vehicle is parked or abandoned on any highway or municipal parking lot within the Village of Weedsport where stopping, standing or parking is prohibited or restricted, said vehicle may be removed by order of any member of the Village of Weedsport Police Department.

B. 
Storage and charges. After removal of any vehicle as provided in this chapter, any law enforcement officer may store or direct storage of said vehicle at a suitable place at the expense of the owner. Such owner, or person in charge of the vehicle, may redeem the same upon payment to the person or business storing said vehicle of the amount of all expenses actually and necessarily incurred in effecting such removal.
C. 
Lien. The person or business so storing said vehicle shall have a lien on the vehicle to the extent of the cost of redemption and may hold said vehicle pending receipt of said sum.
D. 
Liability. The Village of Weedsport, law enforcement officer or agency directing removal and storage, and the person or business removing and storing said vehicle, shall not be liable to the owner or person in charge of said vehicle for any damage which may result from said removal and storage.
A. 
Right turn on red signal shall be permitted at all intersections within the Village of Weedsport except as otherwise marked.
B. 
Vehicles facing a steady red signal may cautiously enter the intersection to make a right turn after first stopping. Such vehicle shall yield the right-of-way to pedestrians lawfully within the adjacent crosswalk and all other vehicles lawfully using the intersection.

The Board of Trustees may appoint one or more Village of Weedsport Parking Enforcement Officers who are hereby authorized to issue and serve appearance tickets for violation of parking regulations within the Village of Weedsport.

A. 
All commercial motor vehicles, as that term is defined by § 501-a(4) of the Vehicle and Traffic Law of the State of New York or successor legislation, in excess of 10,000 pounds' GVWR is hereby prohibited from traveling upon any highways, streets or roads within the corporate limits of the Village of Weedsport.
B. 
Exceptions.
(1) 
Such vehicles shall be allowed to travel on New York State Route 34, New York State Route 31, South Street and East Brutus Street, unless prohibited by county or state regulations.
(2) 
School buses, emergency vehicles, snow removal equipment, municipal vehicles and vehicles making deliveries shall be exempt from the application of this section.

A violation of this chapter shall be classified as a traffic infraction and shall be punished as follows:
A. 
Every person convicted of a violation of § 198-8, Speed regulations, of the Vehicles and Traffic Law of the Village of Weedsport, New York, shall be punished in accordance with penalties established pursuant to § 1180 (h) of the Vehicle and Traffic Law of the State of New York.
B. 
Every person convicted of a violation of any other section of Chapter 198, Vehicles and Traffic, of the Code of the Village of Weedsport, New York, shall be punished in accordance with penalties established pursuant to § 1800 of the Vehicle and Traffic Law of the State of New York.
