A. Prohibited generally. All trades, manufacturers, agricultural or
mechanical employments upon the day designated as Memorial Day pursuant
to § 24 of the General Construction Law are prohibited between
the hours of 9:00 a.m. and 1:00 p.m. on that day, except when the
same are works of necessity, and those expressly permitted under this
section may be performed on that day in their usual and ordinary manner,
provided that such operations shall not interfere with the solemn
observance of Memorial Day.

B. Exceptions designated. All operations and manner of public selling
or offering for sale of any articles or property upon the day designated
as Memorial Day pursuant to § 24 of the General Construction
Law are prohibited, except for the following:
(1) Articles of food may be sold, served, supplied and delivered.
(2) Meals may be sold to be eaten on the premises where sold.
(3) Caterers may serve meals to their patrons.
(4) The public selling or offering for sale of prepared tobacco, bread,
milk, eggs, ice, soda water, fruit, flowers, confectionary, newspapers,
gasoline, oil, tires, drugs, medicines and surgical instruments, and
delivery thereof, shall be permitted.
(5) Grocers, delicatessen dealers and bakeries may sell, supply and deliver
cooked and prepared foods, and farmers' markets or roadside stands
selling fresh vegetables or other farm produce may sell, supply, serve
and deliver merchandise usually sold by them.
(6) Persons holding licenses or permits issued under the provisions of
the Alcoholic Beverage Control Law permitting the sale of beverages
may sell or deliver such beverages.
