As used in this chapter, the following terms shall have the meanings indicated:
CANNABIS
All parts of the plant of the genus Cannabis, whether growing or not; the seeds thereof; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or resin.

ELECTRONIC CIGARETTE or E-CIGARETTE
A battery-operated device that contains a cartridge and/or liquids consisting of chemicals, nicotine and/or flavoring that are turned into vapor which may be inhaled by a user.
HOOKAH
A hookah, also known as a "shisha" or "narghile," is a water pipe used to smoke tobacco.

PUBLIC PLACE
Any place to which the public has access, whether or not that place is on private property. This includes, but is not limited to, any commercial, business, entertainment or professional area within or outside of a building usually open to, frequented by, or used by members of the public.

A. 
The smoking or consumption of cannabis and the smoking of an e-cigarette or hookah shall not be permitted, and no person shall smoke or consume cannabis or smoke an e-cigarette or a hookah in:
(1) 
Any public place.
(2) 
Any government-owned or -operated place.
(3) 
Any place of employment where three or more persons are employed.
(4) 
Any school or child day-care facility.
(5) 
Any public institution.
(6) 
Any private institution, club, lounge, medical care facility or office, charitable or religious facility, food service establishment or theater.
B. 
A violation of the foregoing provisions shall constitute a violation.

A violation of this chapter shall be punishable by a civil penalty of not less than $100 nor more than $500 for each violation.

This chapter shall take effect immediately upon filing with the Secretary of State.
