Be it ordained by the Borough Council of the
Borough of Paulsboro, New Jersey, that it shall be unlawful for any
person or persons, company or corporation to operate or cause to be
operated any motor vehicle commonly known and herein known as a jitney
or omnibus for the purpose of transporting or carrying persons for
hire from one point to another point within the corporate limits of
the Borough of Paulsboro or for transporting passengers from any point
within the corporate limits of the said Borough of Paulsboro to any
point outside the corporate limits of said Borough, without first
securing a license or permit from the Borough Clerk of said Borough
of Paulsboro to place such jitney or omnibus in operation within the
corporate limits of said Borough of Paulsboro, and pay to the Borough
Clerk a fee for said license or permit hereinafter provided.
Said license or permit shall entitle the owner
of said jitney or bus so licensed to operate or drive said jitney
or bus, when properly licensed by the state to drive or operate a
motor vehicle.
A. When owner of such jitney or bus shall desire to have
another person or persons other than himself to drive or operate such
jitney or bus, it shall be necessary for the said person or persons
to secure a jitney or bus driver's license from the Borough Clerk;
said applicant shall be recommended by the owner of the jitney or
bus for which said driver's license is to be granted.
B. No license or permit shall be granted unless said
applicant shall have a state driver's license.
No license or permit shall be issued by the
Borough Clerk for jitney or bus unless application has been made to
the Public Safety Committee of Council, by owner of jitney or bus,
for said license or permit, and shall have been recommended by at
least two members of said Committee and their signatures attached
thereto.
A. Upon proper recommendations, the Borough Clerk shall
issue a license or permit to said applicant, and said license or permit
shall consist of a card not less than 2 1/2 inches by four inches,
upon which shall be printed "Owner's License" or "Driver's License,"
as the case may be. Also, there shall be printed upon one side, Paulsboro
Jitney Owner's License No. ____________________ or Paulsboro Jitney
Driver's License No. ____________________, in large type, together
in smaller type, the make of car and the maker's number. Also, number
of state license on the opposite side in small type. In testimony
whereof, I have set my hand and seal this day of __________ month
_______________ year __________, under which shall appear the signature
of the Borough Clerk, together with the Borough seal; also, a place
shall be set aside for the signature of the licensee, who shall be
required to place his signature thereto. In case the licensee shall
be a company or corporation, then the signature of the president or
secretary shall be required on said license.
B. In ease any change or transfer of said state license
or marker, the licensee shall apply to the Borough Clerk for the necessary
change in jitney licenses, for which the Borough Clerk shall make
an additional charge hereinafter provided.
The Borough Clerk shall provide a suitable metal
tag or marker not less than three inches by six inches, which shall
be stamped or printed "Paulsboro Jitney License No. ____________________
"; also, year issued, said number to correspond with the number upon
the license card issued to the licensee.
Said tag or marker shall be carried in a conspicuous
place upon car, where same can be seen at all times.

A. The annual fee charged for such license shall be for
a jitney or bus, the seating capacity of which is from one to 12 passengers,
$25; for a jitney or bus, the seating capacity of which is 12 or more
passengers, $35 ; and upon payment of such fee by the owner of the
jitney or bus, said owner shall be entitled to operate said car for
which said license is obtained.
B. In case of the applicant operating or causing to be operated more than one jitney or bus at one time, said owner shall first cause the person operating the jitney or bus, other than one operated by himself, to secure a jitney driver's license from the Borough Clerk, under provisions of §
75-3 of this ordinance; the fee for same shall be $2. The same fee shall be charged for extra drivers under §
75-3 of this ordinance. The fee charged for transfer of license from one car to another shall be $1.
This ordinance shall in no way prohibit regular
autobuses not regularly engaged in carrying passengers for hire, when
engaged for carrying picnic parties, lodges, church societies, Sunday
schools, etc., when ordered by said parties, etc., and driven by the
owner or regular chauffeur, nor shall it prohibit any horse-driven
vehicle from carrying passengers in the Borough limits, or upon the
above-mentioned occasions, nor shall it prohibit any person engaged
in the livery business who also may wish to carry or transport passengers
when obliged to do so.
A report of all license fees shall be turned
into the Borough Treasurer by the Borough Clerk monthly, with a cheek
for amount due for the issuance of said licenses.
Any person, company or corporation found guilty
of violating any of the provisions of this ordinance shall, upon arrest
and conviction, pay the following penalties:
A. For violating §
75-1, a penalty of $50 or imprisonment in the county jail 20 days, or both, at the discretion of the Magistrate.
B. For violating §
75-3 of this ordinance, a penalty of $25 or 10 days in the county jail, or both, at the discretion of the Magistrate.
C. For violating provision of §
75-5 of this ordinance, $2.50 or five days in the county jail, or both, at the discretion of the Magistrate.
All ordinances or parts of ordinances pertaining
to or inconsistent with this ordinance are hereby repealed.

The following terms used herein shall be taken
to mean and shall be construed as follows:
TAXICAB
Shall mean any automobile, taxicab or other vehicle propelled
by motor power, engaged in the business of the transportation of passengers
for hire or pay within the Borough of Paulsboro.
PERSON
Shall include natural person, partnership and corporation.
CRUISING
Is hereby defined as the driving of a taxicab to and fro
along a public street or public place at a slow rate of speed for
the purpose of soliciting passengers.
PUBLIC TAXICAB STAND
Is a section of a public street or of a public place set
apart for the exclusive use of a taxicab or a limited number of taxicabs,
when such section is distinctly marked as such by an appropriate sign
attached to a stanchion on the curb or other conspicuous place, or
by clearly visible marks upon the surface of a street or public place.
OWNER
Means any person, corporation or association in whose name
title to any taxicab is registered with the New Jersey Department
of Motor Vehicles, or who appears in such records to be the conditional
vendee or lessee thereof.
Words used in the singular number shall include
the plural, and words used in the plural number shall include the
singular.

It shall be unlawful for any person or persons,

hire from one point to another point within the corporate limits of
the Borough of Paulsboro or for transporting passengers from any point
within the corporate limits of the said Borough of Paulsboro to any
point outside the corporate limits of said Borough, without first
securing a license or permit from the Borough Clerk of said Borough
of Paulsboro to place such taxicab in operation within the corporate
limits of said Borough of Paulsboro, and pay to the Borough Clerk
a fee for said license or permit as hereinafter provided.

There are hereby established two classes of
taxicab licenses, to be known as "taxicab driver's licenses" and "taxicab
owner's licenses," respectively.
A. A taxicab driver's license shall entitle the person
named herein to operate, within this Borough, any taxicab duly licensed
hereunder until the said license either expires or is surrendered,
suspended or revoked. It is not transferable.
B. A taxicab owner's license shall entitle the taxicab
therein described to be operated in this Borough by a driver duly
licensed hereunder until the said license either expires or is surrendered,
suspended or revoked.
C. Such taxicab owner's license may be transferred to
another passenger motor vehicle owned by and registered in the name
of the holder of said license. Application for such transfer shall
be made to the Borough Clerk, who shall issue a new registration for
such other vehicle upon payment of a fee of $1.50 to the Borough Treasurer.
D. Such taxicab license may be transferred to another
person. Application for such transfer shall be made to Borough Council,
and the transfer must comply with all the requirements of state law
and of this ordinance and must have all the qualifications required
by this ordinance. Such transfer must be approved by a majority vote
of Borough Council, and the fee for such transfer shall be the sum
of $25.
All applications for taxicab owner's licenses
and taxicab driver's licenses shall be filed with the Borough Clerk,
who shall submit said applications to Borough Council at the next
succeeding meeting, for action.
All taxicab owner's licenses and all taxicab
driver's licenses shall be issued by a majority vote of Borough Council.
A taxicab owner's license, when issued, shall be construed to permit
an owner to drive or operate a taxicab without a taxicab driver's
license. All owners of such licenses shall notify the Borough Clerk
of any change of address from those registered with said Borough Clerk,
within three days of such change of address.

Every person obtaining a taxicab owner's license
must be at least 21 years of age, a citizen of the United States and
a bona fide resident of the State of New Jersey for at least one year
preceding the date of his application for such taxicab license, If
a corporation, such corporation must be organized and existing under
the laws of the State of New Jersey and shall maintain an office in
the Borough of Paulsboro.
No taxicab owner's license shall be issued until
the applicant shall submit an insurance policy, or certificate in
lieu thereof, and a power of attorney shall have been filed with the
Borough Clerk as provided for taxicabs and autocabs pursuant to the
provisions of the Revised Statutes of New Jersey 48:16-1 to 48:16-22,
inclusive, together with any amendments or supplements adopted or
hereafter adopted relative thereto.

A. Each applicant for a taxicab driver's license shall
be at least 21 years of age, a citizen of the United States, and the
holder of a state driver's license issued by the Department of Motor
Vehicles of the State of New Jersey. Each applicant shall prove to
the satisfaction of the Borough Council or to the satisfaction of
at least two members of the Public Safety Committee of the Borough
Council that he is of good health, has good eyesight, is able to read
and write the English language, that he is of good character and has
sufficient knowledge of the traffic regulations and geography of the
Borough. Every applicant must furnish with the application for such
driver's and owner's license a recent photograph of himself, in duplicate,
two inches wide and two inches high, and the names and addresses of
two responsible property owners of Paulsboro as references. One of
said photographs shall be retained and filed with the application
by the Borough Clerk. Should the applicant be granted a license, the
second photograph shall be fitted into a case by the applicant, to
be always displayed to the passengers in said taxicab.
B. All holders of existing owner's licenses and driver's
licenses shall, upon application for renewal thereof, submit with
their application for a renewal a complete set of fingerprints for
the use of the Borough in investigating the eligibility of the applicants
for renewal of licenses before renewals arc granted. All new applicants
for owner's license or driver's license shall submit with their application
a complete set of fingerprints for the use of the Borough in investigating
the eligibility of the applicants before license is issued. In the
case of a corporate owner, the fingerprints of all the officers and
directors of the corporation shall be submitted with the application.

The number of taxicab owner's licenses issued
and outstanding at any one time shall be 13. All new licenses issued
hereunder shall be issued to owners who devoted their entire time
to the business of operating a taxicab. No new licenses shall be issued
to owners who have other work and devote only a part of their time
to the taxicab business.
Any license may be revoked or suspended at any
time, for cause, by a majority vote of Borough Council.
Any license issued pursuant to the terms of
this ordinance shall expire at 12:00 midnight of the 31st day of December
of the year in which it was issued, unless sooner surrendered, suspended
or revoked.
The fees for the issuance of the licenses herein
referred to shall be as follows:
A. For each taxicab owner's license, the sum of $25 per
year or any fraction thereof.
B. For each taxicab driver's license, the sum of $2 per
year.
There shall be affixed in every taxicab, in
such manner that the same can be conveniently read by any person therein,
a card at least three inches in height by at least five inches in
length, containing the name of the owner, the number of the taxicab
owner's license, the year of issue of such license and the New Jersey
registration number of said taxicab.
No taxicab shall be permitted to park on Broad
Street in the Borough of Paulsboro except in those spaces in the Borough
designated by Borough Council and marked "Taxi Stand," or at such
other places off public streets as may hereinafter be approved by
resolution of Borough Council. Only vehicles licensed as taxicabs
as herein provided shall be permitted to occupy any part of said taxi
stand, and while occupying space in any taxi stand, cabs shall be
immediately available for hire. No driver shall leave his cab unattended
while occupying space in a taxi stand.
No such licensed taxicab, while waiting employment
by passengers, shall stand on any public street or place other than
at or upon the designated public taxicab stand, nor shall any driver
seek employment by repeatedly and persistently driving to and fro
on a short space before, or by otherwise interfering with the proper
and. ordinary access to or egress from, any church, railroad station,
theater, hotel, restaurant or any other public place; but employment
may be solicited by driving through any public street or place, without
stops other than those due to obstructions or traffic, and at a rate
of speed that will not interfere with or impede traffic. "Cruising"
is prohibited.
The rate of fare to be charged within the Borough
limits of the Borough of Paulsboro and surrounding limits shall be
conspicuously posted so that it is easily seen by any passenger in
any part of the taxicab.
Every person or persons, firm or corporation
found guilty of violating any of the provisions of this ordinance
shall be liable to fine of not more than $100 or imprisonment in the
county jail for not more than 30 days. Each succeeding day of violation
shall be construed to be a new violation.
The licensing, regulating and inspecting of
taxicabs; examining applicants for licenses, who own and operate such
taxicab; the licensing of drivers as herein provided; and the enforcement
of the provisions of this ordinance, shall be under the control of
the Mayor and Borough Council.
There is hereby reserved to Borough Council
the right to make, by resolution of Borough Council, such rules and
regulations in relation to the operation of taxicabs and the conduct
of the operators thereof, as Borough Council may from time to time
determine to be necessary and proper in the best interests of the
citizens of the Borough. It is further declared that any violation
of such rules and regulations as made by resolution of Borough Council
shall constitute a violation of this ordinance, punishable as herein
provided.
If any section or part of a section or paragraph
of this ordinance is declared invalid or unconstitutional, it shall
not be held to invalidate or impair the validity, force or effect
of any other section or sections or part of a section or paragraph
of this ordinance.
This ordinance shall take effect immediately
after final passage and publication according to law, and all ordinances
and parts of ordinances inconsistent herewith are hereby repealed;
provided, however, that all licenses issued prior to the adoption
of this ordinance by the Borough of Paulsboro shall remain in effect
for the period stated therein.
