The Department of Law shall be headed by a Director who shall be the Township Attorney and who shall be qualified by training and experience. This position may be part-time.
The Department of Law shall perform all appropriate functions associated with:
A. 
Being legal advisor to the Mayor, members of Council and the Business Administrator.
B. 
Advising as to form and sufficiency of ordinances prior to passage; reviewing and approving contracts, deeds, documents and instruments prior to the execution thereof by or on behalf of the Township.
C. 
Conducting appeals from orders, decisions or judgments affecting any interest of the Township as directed by the Council.
D. 
Entering into any agreement, compromise or settlement of any litigation in which the Township is involved subject to the approval of Council.
E. 
Rendering opinions in writing upon any question of law submitted to him by Council, the Mayor and the Business Administrator.
F. 
Maintaining a record of all actions, suits, proceedings and matters which relate to the Township's interest and report thereon as the Mayor and Council may require.
All papers, documents, memoranda, reports and other materials relating to the administration of the Department of Law shall be and remain the property of the Township. Upon termination of his service with the Township, the Attorney shall forthwith surrender to his successor all such property, together with a written consent to substitution of his successor in all legal actions and proceedings thus pending to which the Township is a party. However, the Mayor, with the advice and consent of Council, may permit the former Attorney to remain as Attorney of Record to represent the Township in those matters to which the Mayor believes the best interests of the Township will be served by retaining the former Attorney.
The Department of Law shall be organized pursuant to plan approved as provided in Article III, § 3-10.

Creation. The position of Deputy Township Attorney is hereby created within the Department of Law. The Deputy Township Attorney shall report to the Law Director - Township Attorney.
B. 
Appointment. The Deputy Township Attorney shall be appointed by the Mayor with the advice and consent of the Counsel.
C. 
Term. The term of the Deputy Township Attorney shall be for one year.
D. 
Duties. The Deputy Township Attorney shall have such duties as may be assigned from time to time by the Law Director - Township Attorney, or shall represent the Township in any matters from which the Township Attorney is conflicted.
E. 
Compensation. The Deputy Township Attorney shall be compensated on such terms as the Council may determine.

Creation. The position of Conflicts Land Use Attorney is hereby created within the Department of Law. The Conflicts Land Use Attorney shall report to the Law Director - Township Attorney.

Appointment. The Conflicts Land Use Attorney shall be appointed by the Mayor with the advice and consent of the Counsel.
C. 
Term. The term of the Conflicts Land Use Attorney shall be for one year.
D. 
Duties. The Conflicts Land Use Attorney shall have such duties as may be assigned from time to time by the Law Director - Township Attorney and shall represent the Land Use Boards of the Township in any matters from which the appointed Board Attorney is conflicted, with the consent of the land use boards.
E. 
Compensation. The Conflicts Land Use Attorney shall be compensated on such terms as the Council may determine.
