A person shall be deemed to be a dealer in gold and other precious metals
or secondhand jewelry if he is engaged in the business of purchasing, offering
to purchase, swapping, offering to swap, accepting for consignment, selling,
offering to sell, hypothecating or otherwise dealing in or trading gold and
other precious metals, articles made therefrom, coins, with or without numismatic
value, used jewelry of all descriptions, sterling silver, silver plate, precious
gems, semiprecious gems or watches, other than as a consumer buying the same
in a normal commercial manner or as an incidental seller of such an item so
acquired.

No person shall engage in the business of dealing in the commodities,
merchandise or articles hereinabove described until a permit to do so has
been obtained from the Chief of Police, which permit shall be issued upon
the applicant's identifying himself to the satisfaction of the Chief
of Police and payment to the Township Clerk of a fee of $100.
Every dealer or trader in the commodities, merchandise or articles hereinabove
described shall keep a suitable, legible and complete record of each item
thereof purchased or received by him reciting the date and time acquired and
the price paid therefor, together with the name, residence, occupation, age
and correct description of the person from whom he received the item. The
records shall be on forms approved by the Township Police Department and shall
be available for inspection by the Township Police Department at all times.
Every dealer in the commodities, merchandise or articles hereinabove
described shall produce for inspection and copying, to the Township Police
Department on demand, during normal business hours, a legible and correct
transcript of the records of his transactions. Said transcript shall be on
forms prescribed by the Chief of Police.
No dealer in the commodities, merchandise or articles hereinabove described
shall sell, melt, change the form of, remove from the premises or otherwise
dispose of any article bought or received by him in the Township of River
Vale within five business days unless the proposed transaction is reported
to the Chief of Police as herein required. Any dealer wishing to store his
merchandise other than on the premises where he is engaged in business may
make application to the Chief of Police for permission to remove the same
from his premises to the alternate designated location; provided, however,
that said location is in the Township of River Vale.
It shall be a violation of this chapter to transact any business to
which this chapter refers without having first obtained the permit herein
required or to fail to adhere to the recordkeeping and reporting requirements
hereof. It shall be a separate and distinct violation of this chapter for
each article and each transaction which shall be omitted from the reports.
The initial offense under this chapter shall be punishable as provided in Chapter
1, General Provisions, Article
I, §
1-14. Any subsequent offense shall, in addition to the aforesaid penalties, result in the revocation of the dealer's permit by the Township Council.
