For the purposes of this article, the Township's recreation facilities shall include all premises utilized for recreational purposes, which are owned or controlled by the Township, as well as the grounds surrounding same, the structures and buildings thereon, and the areas adjacent thereto which are set aside for the parking of vehicles and bicycles.
A. 
Hours for use of recreation facilities are as follows:

(1) 
The Mark Lane Complex shall be open for use between the hours of 8:00 a.m. to 10:00 p.m. every day of the week, with the exception of the walking path which shall be accessible to the public from sunrise to 10:00 p.m. and with the exception of Saturday nights, when two banks of lights may remain on until 11:00 p.m. solely for cleanup. The Mayor may waive these requirements in emergency situations.
(2) 
Ranges Soccer Field shall be open for use between the hours of 8:00 a.m. to 9:30 p.m.
(3) 
All other recreation facilities shall be open for use between 8:00 a.m. to 9:30 p.m.
B. 
Any person utilizing a recreation facility at a time other than provided herein shall be in violation of this article. The hours of operation shall be posted at each facility. The facilities shall be subject to further closure as provided for in this article.

A. 
A permit from the Department of Recreation shall be required for use of all facilities except tennis courts, basketball courts, and walking paths. Applicants must have the permit in their possession at the facility during use. The permit application shall be on a form established by the Department of Recreation. Prior registration with the Department of Recreation is required to access the pickleball courts.
B. 
The use of basketball courts and tennis courts is hereby restricted to the residents of the Township and their guests and to programs sanctioned by the Township. The use of pickleball courts is permitted by residents and nonresidents and to organized programs sanctioned by the Township only.
C. 
Township-sponsored groups have priority use of all facilities. Thereafter, permits shall be issued on a first-come-first-granted basis.
D. 
Each organization that wishes to use any recreational facility must provide the Township Business Administrator with a certificate of insurance and sign a hold-harmless form provided by the Township. The certificate of insurance must show evidence of $1,000,000 general liability coverage, and the Township must be named as an additional insured. Township-sponsored groups are exempt from this requirement.
E. 
The Director of Recreation shall have the discretion to reasonably schedule seasons and events.
F. 
Fees for the use of any recreational facilities will be determined in accordance with § 105-5, Fees.

B. 
Recreational facilities. Subject to the exclusions provided in Subsection B(10), fees for the use of recreational facilities shall be as follows:
(1) 
Per time slot for field use by a resident team or resident corporation: $100.
(2) 
Per time slot for field use by a nonresident team or nonresident corporation: $200.
(3) 
Per use for the community/senior center by a nonresident organization: $50.
(4) 
Pickleball court use for River Vale residents: $25 one-time registration fee per family. Each additional key fob per family: $10.
(5) 
Pickleball court use per person, per calendar year, for nonresidents: $50.
(6) 
Pickleball court key fob replacement, residents and nonresidents: $10.
(7) 
Definitions. As used herein, the following terms will have the meanings set forth below:
NONPROFIT ORGANIZATION
Any organization that is not organized or and does not exist for the purpose of making a profit and which does not pay its coaches or directors a fee or salary.
NONRESIDENT CORPORATION
Any company that does not own or lease commercial property within the Township of River Vale.
NONRESIDENT TEAM
Any athletic team that does not have at least 75% of its roster filled with River Vale residents.
NONRESIDENT ORGANIZATION
Any nonprofit organization or group that does not have at least 75% of its members as River Vale residents.
RESIDENT CORPORATION
Any company that owns or leases property within the Township of River Vale.
RESIDENT TEAM
Any athletic team comprised of at least 75% of its roster with River Vale residents.
TIME SLOT
An uninterrupted two-hour time period, or any part thereof, that a field is being used by an approved team.
(8) 
Any field use requiring use of lights will require an additional fee of 10% of the total applicable fee.
(9) 
There will be no credit provided for any unused field time slots.
(10) 
Notwithstanding the foregoing, any athletic team that is part of the following organizations shall be excluded from the provisions hereof:
(a) 
River Vale Basketball Association (RVBA);
(b) 
River Vale Rascals Preschool Soccer;
(c) 
River Vale T-Ball;
(d) 
River Vale Baseball/Softball (RVBSA);
(e) 
River Vale Junior Football and Cheerleading (RVJFA);
(f) 
River Vale Youth Soccer Association (RVYSA);
(g) 
Pascack Valley Youth Soccer;
(h) 
Pascack Valley Junior Wrestling;
(i) 
Pascack Lacrosse;
(j) 
River Vale Board of Education; and
(k) 
Pascack Valley High School.
(11) 
Also notwithstanding the foregoing, any athletic team comprised of at least 75% of its roster with River Vale residents and which operates as a nonprofit organization shall be excluded from the provisions hereof.
(12) 
Fees for special events (including charity events, tournaments, fundraisers, etc.) will be determined at the discretion of the Department of Recreation on an event-by-event basis.
(13) 
Any person (including any team, corporation, or other organization) found in violation of the provisions hereof will be subject to a fine not to exceed twice the amount of fees that would have otherwise been imposed upon such person pursuant to the provisions of this section. In addition to any fines imposed hereof, violations of this section may result in the loss of future field use privileges.

The Director of Athletics and, in the Director's absence, the Mayor or a person designated by the Mayor, is hereby authorized to close any recreation facility in order to maintain and/or prevent harm to the facility. Notice of any emergency closing shall be posted at the facility and shall negate any permit previously provided.

All recreational facilities shall be posted with signs depicting the hours of operation.
It shall be unlawful for any resident or nonresident to park or operate a motor vehicle in any recreation facility area, other than in a designated area.

A. 
Alcohol/drugs prohibited. No person under the influence of alcohol or drugs shall be permitted within a Township recreation facility area. No person shall possess or consume alcoholic beverages within any recreation facility without authorization of the governing body in accordance with law.
B. 
Littering prohibited. No person shall leave bottles, broken glass, ashes, wastepaper or other rubbish within a recreational facility except in a properly provided receptacle designated for that purpose.
C. 
Property damage prohibited. No person shall cut, break, dig up or in any way mutilate any railing, seat, fence, structure or any other object within a recreational facility.
D. 
Fires and fireworks. No person shall build, light or maintain a fire within a recreation facility except in receptacles provided for that purpose and only with permission from the Department of Athletics. No person shall discharge or set off any fireworks within any recreation facility without permission from the governing body.
E. 
Firearms and hunting prohibited. No person shall discharge any weapon or firearm within the boundaries of a recreation facility or possess any weapons. No person shall hunt, trap, molest, remove, injure or kill any animal or disturb its habitat within the area of a recreation facility.
F. 
Maintenance. Each using group shall police the recreation facility after each event to rid the facility of any litter. Failure to clean such facility shall be a violation of this article.
G. 
Dogs are prohibited.
H. 
Golf is prohibited.
For each and every violation of any of the provisions of this article, the person and/or organization convicted of the violation shall be subject to the penalties provided in Chapter 1, General Provisions, Article I, § 1-14. The fine shall be doubled for conviction of a second offense. Any person or organization convicted of a second offense shall be placed on probation for a period of six months. Any person or organization convicted of violating this article while on probation shall be prohibited from obtaining a permit for two years.
