No street, avenue, court, alley or other highway
shall be accepted by the city, nor shall any work thereon be done
by the city for the opening, grading or otherwise improving of the
same, nor shall any crosswalks be constructed thereon, nor street
lights installed, until the owner or owners of the plot or addition
in which such highways are included shall have filed with the Director
of the Department of Public Works a certified map or plan showing
all of such highways dedicated to the city and the lots abutting thereon,
nor shall the same be accepted until such highways have been graded
from fence line to fence line at a grade to be fixed by the Bureau
of Engineering, and sewers laid therein, subject to the approval of
the City Engineer.
No street or avenue shall hereafter be accepted
by the city unless it shall be of a width of not fewer than fifty
(50) feet from fence line to fence line and shall extend through from
street to street. Nor shall any street or avenue be accepted the plan
for which does not include also the dedication of cross or intersecting
streets or avenues at places or intervals of at least every six hundred
(600) feet. Nor shall any court or alley be accepted by the city unless
it shall be of a width of sixteen (16) feet from fence line to fence
line.
No street or avenue shall hereafter be accepted
by the city until there shall have been laid on both sides thereof
five (5) foot flagstone or concrete sidewalks at a grade fixed by
the Bureau of Engineering.
Upon the advice of both the City Planning Commission
and the City Engineer that any of the provisions of this Article is
working or will work a hardship upon those desiring to dedicate new
streets or courts to the city, Council may waive any or all of the
provisions of such sections and accept streets and courts dedicated
to the city upon the recommendation of both the City Planning Commission
and the City Engineer, even though such streets and courts do not
comply with all of the provisions of this Article. The waived provisions
shall be noted in the ordinance accepting the streets or courts.
