This chapter, together with the Building Officials and Code Administrators (BOCA) Basic Building Code, 1981 Edition, adopted herein, shall be known and may be cited as the "Building Code of the Borough of Steelton."
A. 
BOCA Basic Building Code. There is hereby adopted in its entirety by the Borough of Steelton, copies of which are on file in the office of the Borough, that certain building code known as the "BOCA Basic Building Code, 1981 Edition," as amended through the effective date of adoption of this chapter and as published by the Building Officials and Code Administrators International, Inc., save and except portions as are hereinafter deleted, modified or amended.
B. 
Application. The provisions set forth in this chapter and in the BOCA Basic Building Code adopted herein shall take effect 31 days from the date of the enactment of this chapter or any amendment thereto and shall apply throughout the entire Borough.
All the provisions of the Code Enforcement Ordinance of the Borough are hereby adopted with this chapter.[1] The administration and enforcement of this chapter and of the BOCA Basic Building Code, herein adopted, shall be carried out by the Office of Code Enforcement of the Borough in accordance with the procedures established by the Code Enforcement Ordinance of the Borough and by the BOCA Basic Building Code adopted herein. Said Code Enforcement Ordinance provides for certain powers and duties of a Code Enforcement Officer, for the creation of a Code Hearing Board and for procedures relative to applications, fees, permits, inspections, appeals, penalties and other matters.

B. 
Amendments. The following sections and subsections of the BOCA Basic Building Code are hereby amended to read as follows:
(1) 
Section 100.1, Title, is amended to read as follows:
100.0 Title: These regulations shall be known as the "Building Code of the Borough of Steelton," hereinafter referred to as "this code."
(2) 
Section 501.2, Fire limits, is amended to read as follows:
501.2 Fire limits: The fire limits shall comprise the areas containing congested business, commercial, manufacturing and industrial uses or in which such uses are developing. The limits of such areas shall be as follows: "That area within the boundaries described starting at a point located at the intersection of Second and Adams Streets; thence southeast along Second Street to Chestnut Street; thence southwest along Chestnut Street and Chestnut Street extended to the canal, formerly the Pennsylvania Canal; thence northwest along the canal or line of the canal, formerly the Pennsylvania Canal to Adams Street; thence northwest along Adams Street to Second Street, the point and place of beginning."
(3) 
Section 627.4, Locations, is amended to read as follows:
627.4 Locations: The pool must be located within a side or rear yard and may be located no closer than six feet to any property line of the property on which it is located; provided, however, that to the extent a property line includes a street right-of-way or cartway within the lot, no portion of the structure of the pool shall encroach on said cartway or improved right-of-way; to the extent such right-of-way is not improved, no portion of the aforesaid pool structure may encroach upon said nonimproved right-of-way without the specific written permission of the Borough Council of the Borough of Steelton.

Section 629.1, Applicability, is amended to read as follows:
629.1 Applicability: The provisions of this section shall apply to all buildings of the Group B when five or more stories in height and Use Group R-1 and R-2 when four or more stories in height.
(5) 
Section 809.4, Emergency escape, is amended to read as follows:
809.4 Emergency escape: Every sleeping room below the fourth story in buildings of Use Group R shall have at least one operable window or exterior door approved for emergency egress or rescue. The units must be operable from the inside opening without the use of separate tools. Where windows are provided as a means of egress or rescue, they shall have a sill height not more than 44 inches (1,118 millimeters) above the floor. All egress or rescue windows from sleeping rooms must have a minimum net clear opening of 5.7 square feet (0.53 square meters). The minimum net clear opening height dimension shall be 22 inches (558 millimeters).
Bars, grills or screens placed over emergency escape windows shall be releasable or removable from the inside without the use of a key, tool or excessive force.
Exceptions
1.
Grade floor windows may have a minimum net clear opening of five square feet (0.47 square meters).
2.
In buildings of Use Group R-3, where the sleeping room is provided with a door to a corridor having access to two remote exits in opposite directions, then an outside window or an exterior door for emergency escape from each such sleeping room is not required.
(6) 
Section 812.5.4, Panic hardware, is amended to read as follows:
812.5.4 Panic hardware: All exit doors equipped with latching devices in buildings of Use Groups A, B, F and I-2 and Use Groups R-1 and R-2 with an occupancy load greater than 50 or three stories or more in height shall be equipped with approved panic hardware. Acceptable panic hardware will be a door-latching assembly incorporating a device which causes the door latch to release and the leaf to open when a force of 15 pounds (66.68 newtons) is applied in the direction of egress to a bar or panel, the activating portion of which extends not less than 1/2 the width of the door leaf, and applied at a height greater than 30 inches (762 millimeters) but less than 44 inches (1,118 millimeters) above the floor. The force shall be applied at the lock side of the door or 30 inches (762 millimeters) from the hinged side, whichever is farther from the hinge.
(7) 
Section 823.1, Location, is amended to read as follows:
823.1 Location: In all buildings having an occupant load of 10 or more, all required means of egress shall be indicated with approved internally illuminated signs reading "exit," visible from the exit access and, when necessary, supplemented by directional signs in the access corridors indicating the direction and way of egress. All exit signs shall be located at exit doors or exit access areas, so as to be readily visible.
(8) 
Section 824.4.2, Use Group B, is amended to read as follows:
824.4.2 Use Group B: In all buildings of Use Group B containing more than 50 occupants or three or more stories in height.
(9) 
Section 824.4.3, Use Group M, is amended to read as follows:
824.4.3 Use Group M: In all buildings of Use Group M when greater than 2,000 square feet in area on any floor, or where having one or more floors above grade floor.
(10) 
Section 824.4.4, Use Group R-1, is amended to read as follows:
824.4.3 Use Group R-1: In buildings of Use Group R-1 containing more than 25 sleeping rooms or three or more stories in height.
(11) 
Section 824.4.5, Use Group R-2, is amended to read as follows:
824.4.5 Use Group R-2: In all buildings of Use Group R-2 containing more than 50 occupants or three or more stories in height.
(12) 
Section 824.4.6, Windowless buildings, is amended to read as follows:
824.4.6 Windowless buildings: In all windowless buildings or portions thereof, except buildings of Use Group R-3.
(13) 
Section 1225.9.1, Asphalt shingle application, is amended to read as follows:
1225.9.1 Asphalt shingle applications: Not more than one overlay of asphalt shingles shall be applied over an existing asphalt shingle roof. Asphalt shingles shall not be applied over wood shakes.
(14) 
Section 1702.4, Use Group A-3, is amended to read as follows:
1702.4 Use Group A-3: In building or structures or portions thereof of Use Group A-3 when more than 8,000 square feet in area.
(15) 
Section 1702.8, Use Groups M, S-1 and F, is amended to read as follows:
1702.8 Use Groups M, S-1 and F: In all buildings or structures of Use Group M, S-1 and F:
1.
When more than 8,000 square feet in area;
2.
When more than 16,000 square feet in total area on all floors; or
3.
When more than two stories in height.
(16) 
Section 1711.2.1, Use Groups A-1, A-2 or A-3, is amended to read as follows:
1711.2.1 Use Group A-1, A-2 or A-3: In buildings two or more stories in height of Use Group A-1, A-2 or A-3 with an occupant load of more than 150.
(17) 
Section 1711.2.2, Three stories, is amended to read as follows:
1711.2.2 Three stories: In buildings three stories in height when:
1.
Of Use Group B, F, M, or S-1 more than 1,500 square feet in area per floor;
2.
Of Use Group A, I, R-1 or R-2; or
3.
Of any use group more than 5,000 square feet in area per floor.

Section 1716.3.3, Use Group B or R-2, is amended to read as follows:
1716.3.3 Use Group B or R-2: In all buildings of Use Group B when five or more stories in height, Use Group R-2 when four or more stories in height.
(19) 
Section 1717.3.4, Use Group R-2, is amended to read as follows:
1717.3.4 Use Group R-2: In all buildings of Use Group R-2 when three or more stories in height.
(20) 
Section 1807.2.1, Deep excavations, is amended to read as follows:
1807.2.1 Deep excavations: Whenever an excavation is made to a depth of more than three feet (914 millimeters) below the established curb, the person who causes such excavation to be made, if afforded the necessary license to enter the adjoining premises, shall preserve and protect from injury at all times and at his own expense such adjoining structure or premises which may be affected by the excavation. If the necessary license is not afforded, it shall then be the duty of the owner of the adjoining premises to make his building or structure safe by installing proper underpinning or foundations or otherwise. Such owner, if it be necessary for the prosecution of his work, shall be granted the necessary license to enter the premises where the excavation or demolition is contemplated.
C. 
Additions. The following new sections and subsections shall be added to the BOCA Basic Building Code.
(1) 
Dwelling units (Use Group R-3): Smoke detectors shall be installed outside of each separate sleeping area in the immediate vicinity of the bedrooms in dwellings within Use Group R-3 and on each additional story of the family living unit, including basements and excluding crawl spaces and unfinished attics. Detectors shall be installed in a manner and location approved by the Office of Code Enforcement (the authority having jurisdiction).
(2) 
Improvement or additions to existing dwelling units: A minimum of one approved smoke detector shall be installed in accordance with NFPA Standard No. 74 upon the installation of a wood stove and in every case of a capital improvement or addition to an existing dwelling unit or remodeling (including repair, reconstruction or removal of any part) of an existing dwelling unit when the cost of any such changes exceeds $500.

See Chapter 60, Flood Damage Prevention, and the latest officially issued federal floodplain mapping. If a provision of this chapter regulates the exact same matter as a provision of the Flood Damage Prevention chapter, the provision that is most restrictive upon use and development shall apply.
Any person, firm or corporation who shall violate any provisions of this chapter and/or the Borough's Building Code shall, upon conviction in a summary proceeding, before any District Justice,[1] be sentenced for each such violation to pay a fine of not less than $10 plus costs and not more than $300 plus costs, and in default thereof, to undergo imprisonment in the county jail for a period not exceeding 30 days. Each day that a violation continues after due notice has been served, in accordance with the terms and provisions hereof, shall be deemed a separate offense.

A. 
Savings clause. Nothing in this chapter or in the BOCA Basic Building Code hereby adopted shall be construed to affect any suit or proceeding now pending in any court or any rights acquired or liability incurred or any cause or causes of action accrued or existing under any act or ordinance repealed hereby. No right or remedy of any character shall be lost, impaired or affected by this chapter.
B. 
Validity. The invalidity of any section or provision of this chapter or the BOCA Basic Building Code herein adopted shall not invalidate other sections or provisions thereof.
C. 
Repealer. The Borough of Steelton's Building Code, Ordinance No. 78-1, and any chapter or code provisions conflicting with the provisions hereof, are hereby repealed insofar as they are inconsistent with this chapter.
