The following words and phrases, when used in this chapter, shall have the meanings given to them hereinafter unless the context clearly indicates otherwise:
ASHES
Residue from fires used for cooking or heating buildings.
DISPOSAL CONTRACTOR
The contractor retained by the City for the purpose of collecting garbage, certain refuse and recyclable materials from one- and two-family dwellings within the City.
GARBAGE
Wastes resulting from the handling, preparation, cooking or consumption of food; wastes from the handling, storage and sale of produce.
RECYCLABLE MATERIALS
Those materials suitable for recycling as determined by agreement between the City and its disposal contractor. A list of such materials shall at all times be available for public inspection in the office of the City Clerk during regular business hours.
RECYCLE CONTAINERS
Containers provided by the disposal contractor for the purpose of collecting and disposing of recyclable materials.
REFUSE
Combustible trash, including, but not limited to, paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture, bedding; noncombustible trash, including, but not limited to, metals, tin cans, metal furniture, dirt, small quantities of rock and pieces of concrete, glass, crockery, other mineral waste; street rubbish, including, but not limited to, street sweepings, dirt, leaves, catch basin dirt, and contents of litter receptacles; but "refuse" does not mean earth and wastes from building operations, nor shall it include solid wastes resulting from industrial processes and manufacturing operations such as food processing wastes, boilerhouse cinders, lumber, scraps, and shavings.
A. 
The City of Lexington shall through its disposal contractor provide a garbage and refuse collection and disposal service and for the collection and disposal of recyclable materials to persons owning or residing in one-family and two-family dwellings within the City of Lexington in the manner and to the extent provided in this article. The City shall not provide such service to any commercial, manufacturing, industrial or business enterprise, to persons residing in residential buildings containing more than two dwelling units, or within any mobile home park.
B. 
The City Council shall from time to time establish by ordinance, resolution or motion a monthly fee for providing for the collection and disposal of garbage, certain refuse and recyclable materials. Amounts due for such service shall be billed by the City Collector.
C. 
All two-family dwellings shall be considered as two separate dwellings, and a separate billing shall be issued to each dwelling. The monthly fee established as prescribed by this chapter shall be charged to every one-family and two-family dwelling within the City of Lexington which is occupied or maintained in a condition that permits immediate occupancy, is subject to billing for or receives City water services, and is actually receiving services as provided by this chapter. The owner of the premises, the occupant thereof and the user of the service shall be jointly and severally liable to the City. The service charge for such collection and disposal shall be due and payable on or before the dates set by the City. The City of Lexington shall provide collection and disposal service to the premises at least once each week.
D. 
A penalty of 10% of the amount due shall be added to all bills not paid on or before the due date established as hereinabove set forth.
A. 
Any owner or occupant of a dwelling unit in a one-family or two-family dwelling shall use receptacles provided by the disposal contractor.
B. 
No owner or occupant of a dwelling unit in a one-family or two-family dwelling shall use metal drums, fiber or paperboard drums, wire trash burners, barrels, paper shopping bags, cardboard boxes, receptacles without lids, open plastic bags or containers having sharp or jagged exposures.
C. 
No person shall place for disposal by the disposal contractor and the disposal contractor shall not collect any of the following forms of refuse:
(1) 
Waste from building and construction operations;
(2) 
Solid waste resulting from industrial processes and manufacturing operations such as food processing waste, boilerhouse cinders, lumber, scraps and shavings;
(3) 
Paper, cartons, boxes, barrels, wood, excelsior, tree branches, yard trimmings, wood furniture, bedding;
(4) 
Noncombustible trash including, but not limited to, metals, tin cans, metal furniture, dirt, quantities of rock and pieces of concrete, glass, crockery and other mineral waste;
(5) 
Street rubbish including, but not limited to, street sweepings, dirt, leaves, catch basin dirt and contents of litter receptacles.
D. 
Only recyclable materials shall be placed in recycle containers.
No earlier than 6:00 p.m. of the day preceding collection, any owner, operator or occupant desiring to utilize the City's collection service shall place or cause to be placed approved receptacles containing garbage, approved refuse and recyclable materials upon the curb or within five feet of the City street in front of the premises served. The City Council, by ordinance, resolution or motion shall establish the day or days for collection of garbage, approved refuse and recyclable materials by the disposal contractor. Empty receptacles must be removed from street-side collection points by the end of the day of collection and stored in such manner as to prevent disbursal of waste materials by wind and animals.
