It shall be unlawful for any person under 17
years of age to be or remain in or upon any public street, avenue,
sidewalk, alley, lane or public place in the Village of Athens after
the hour of 11:00 p.m. in the evening unless such person is accompanied
by his parent, guardian or other person having the legal custody of
such minor person, or unless the employment of such minor person makes
it necessary to be upon such street, avenue, sidewalk, alley, lane
or in such public place during the nighttime after such specified
hour.

Any person committing an offense against any provision of this article shall, upon conviction thereof, be punishable as provided in Article
I, General Penalty, of Chapter
1, General Provisions, of the Code of the Village of Athens.

For many years, and to an increasing degree
in the past few years, there have been acts of vandalism, mischief,
assaults and harassment on Halloween night. These actions have disturbed
the peace and good order of the Village and have resulted in injuries
to persons and damage to and destruction of property. The only reasonable
and effective way to prevent or minimize these actions is by enacting
and enforcing a curfew.
On Halloween night of each year, commencing
on October 31 at 8:00 p.m. and continuing through November 1 at 6:00
a.m., no person 19 years of age and under shall be on a public street,
sidewalk, place of business, park, alley or any other place open to
the public within the Village of Athens.
This article shall not apply to persons within
the immediate physical custody and company of their parent or legal
guardian.
Violations of this article shall be punishable
by fine of up to $250 or by 15 days in jail, or both fine and jail.
