For brevity and ease of communication, this chapter may be cited as the "Town of Wawayanda Sewer Use Code."

A. 
The purpose of this chapter is to provide for the maximum possible beneficial public use of the Town's wastewater facilities and to prevent public health problems through regulation of sewer construction, sewer use, wastewater treatment, and wastewater discharges. This chapter shall also provide procedures for complying with the requirements contained herein and penalties for violation thereof.
B. 
Application.
(1) 
The provisions of this chapter shall apply to the discharge of all wastewater from facilities within the Town of Wawayanda. This chapter also provides for regulation of sewer construction, control and assurance that existing customers' capacity will not be preempted, approval of sewer construction, construction plans, separate contracts for significant industrial users, minimum sewer connection standards and conditions, and penalties and other procedures in cases of violation of this chapter.
(2) 
This chapter shall also apply to all sanitary wastewater collection and treatment within the Town of Wawayanda and regardless of whether those facilities are located within a legally formed sewer district.
C. 
The Town's Sewer District No. 1 utilizes the City of Middletown's wastewater treatment facilities. Construction within Sewer District No. 1 must also comply with the rules and regulations of the City of Middletown related to sewer uses.
