This chapter is adopted for the purpose of regulating the time for the sale of alcoholic beverages in the Borough of Ho-Ho-Kus, in the County of Bergen, in accordance with the provisions of the Act of the legislature entitled "Alcoholic Beverage Law," being Title 33, Chapter 1, of the Revised Statutes of 1937,[1] its supplements and amendments, and in accordance with the rules and regulations issued or to be promulgated by the State Commissioner of Alcoholic Beverage Control, applicable thereto.

No licensee shall sell, serve, deliver or allow, permit or suffer the sale, service or delivery of any alcoholic beverage, nor allow the consumption of any alcoholic beverage on the licensed premises, on New Year's Day when it is a weekday, between the hours of 6:00 a.m. and 8:00 a.m.; on New Year's Day when it is a Sunday, between the hours of 5:00 a.m. and 12:00 noon; on other weekdays, between the hours of 3:00 a.m. and 8:00 a.m.; nor on other Sundays, between the hours of 3:00 a.m. and 12:00 noon.

All licenses shall be for a term of one year, from July 1 in each year. The respective fees for any such licenses shall be prorated according to the effective date of such license and based on the respective annual fee, as hereinafter provided. The annual license fee and the number of licenses governing the sale and distribution of licensing privileges in the Borough of Ho-Ho-Kus shall be as follows:
A. 
Not more than one plenary retail consumption license, the annual fee for which shall continue to be $1,000, and shall be increased annually as follows:
(1) 
Commencing July 1, 1975, the sum of $1,200.
(2) 
Commencing July 1, 1976, the sum of $1,440.
(3) 
Commencing July 1, 1977, the sum of $1,725.
(4) 
Commencing July 1, 1978, and for every license year thereafter unless this chapter is amended, the sum of $2,000.
B. 
Not more than five plenary retail distribution licenses, the annual fee for each shall continue to be $400, and shall be increased annually as follows:
(1) 
Commencing July 1, 1975, the sum of $480.
(2) 
Commencing July 1, 1976, the sum of $575.
(3) 
Commencing July 1, 1977, the sum of $690.
(4) 
Commencing July 1, 1978, the sum of $825.

A. 
The annual fee for a club license [provided for in N.J.S.A. 33:1-12(5) and State Regulation No. 7] is hereby fixed at $50.
B. 
Not more than one such license shall be issued in the Borough of Ho-Ho-Kus.
This chapter shall take effect when passed and published as required by law.
