No person shall discharge or cause to be discharged an apparatus commonly known as a "paintball gun" or any air guns, pellet guns or any other instrument which propels projectiles in and about any public property, including but not limited to public parks, playgrounds, open space, recreation facilities or any other public facility within the Borough. Any discharge of a paintball gun, air gun, pellet guns or any other instrument which propels projectiles in or about private property within the Borough shall be performed only with the consent of the property owner and in a manner as to ensure that the aforesaid device and all projectiles are confined to the limits of the private property where discharged therefrom.
Any person violating any provision of this chapter shall, upon conviction thereof, be subject to a fine not to exceed $1,000 or imprisonment for a term of not more than 90 days, or both.
All other ordinances of the Borough, or parts thereof, which are in conflict with this chapter are hereby repealed to the extent of such conflict.
If any section, subsection, paragraph, sentence, clause, phrase, or word contained in this chapter shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this chapter, which shall remain in full force and effect, and, to this effect and to this end, the provisions of this chapter are hereby declared to be severable.
This chapter shall take effect upon passage and publication as required by law.
