This chapter is adopted in order to protect the health, safety
and well-being of persons and property by prohibiting certain animals
within the Borough of Ho-Ho-Kus. The Borough Council of Ho-Ho-Kus
finds that the harboring of certain animals within the Borough may
be offensive to other residents so as to constitute a public nuisance
and may pose a threat to the safety of its inhabitants and their property.
Any of the animals set forth in this chapter which have been
kept, maintained, possessed or controlled by any person within the
Borough limits of the Borough of Ho-Ho-Kus prior to the effective
date of this chapter shall be grandfathered and exempt from the regulations
herein. However, the owner or any person keeping, maintaining or having
possession or control of such animal(s) must nevertheless register
such animal(s) with the Animal Control Officer within 60 days from
the effective date hereof. No offspring or replacement of such exempt
animal(s) shall be entitled to a continued exemption.
The provisions of this chapter shall be enforced by the Animal
Control Officer or any police officer of the Borough of Ho-Ho-Kus.
Any person who violates any provisions of this chapter shall,
upon conviction thereof, be punished by a fine not exceeding $1,000
or by imprisonment for a term not exceeding 90 days, or both. A separate
offense shall be deemed committed on each day during or on which a
violation occurs or continues.
