It shall be unlawful to give or hold any circus, play, exhibition, common show or theatrical performance within the limits of the Borough of Ho-Ho-Kus without having first obtained a license for that purpose.
It shall be unlawful to give or hold any circus, play, exhibition, common show or theatrical performance or any public amusement where the speed of horses, speed or kinds of automobiles or airplanes are exhibited and where an admission fee is charged in any building, tent or structure or grounds, without such building, tent, structure or grounds being licensed for that purpose.
The license fees shall be as follows:
A. 
Concert hall: $5 per day or $100 per year.
B. 
Common show: $5 per day.
C. 
Theater for the exhibition of moving pictures: $5 per day or $50 per year.
D. 
Open-air moving pictures: $5 per day or $50 per year.
E. 
Public dance hall: $5 per day or $100 per year.
F. 
Theaters for exhibitions or shows other than moving pictures: $5 per day or $100 per year.
G. 
Traveling or other street shows: $5 per day or $100 per year.
H. 
Places where speed of horses, etc., is shown:
(1) 
Any place of public amusement where the speed of horses or breed of horses or speed or kinds of automobiles or airplanes are exhibited and an admission fee is charged: $50 per day or $500 per year.
(2) 
The owner of any racetrack, grounds or place of public amusement where the speed of horses or breed of horses or speed or kinds of automobiles or airplanes are exhibited for which an admission fee is charged shall not be required to take out a license for each of such shows or exhibitions as provided for in this article, provided that the receipts of the admission to such shows or exhibitions shall be for the sole benefit of the owners of the ground or place where such show or exhibition is given, and provided further that the owner has taken out a yearly license for such grounds or place. Said license fee is hereby fixed at $50 per year, all licenses to expire on the 31st day of December in each year.

Licenses shall be issued by the Borough Clerk on application in writing stating the time and place when and where such circus, play, exhibition, theatrical performance, common show or public amusement shall be given, and the owner or person in charge thereof, which application shall be accompanied by the license fee herein provided.
The license fees fixed in this article are imposed for revenue.
Any person or persons giving or taking part in or permitting any grounds, building or structure of any kind to be used for any circus, play, exhibition, theatrical performance, common show or traveling show or public amusement, without having first obtained a license for that purpose as herein provided, or any corporation or corporations, person or persons permitting to be used any building, structure or grounds for any such purpose without a license having been first obtained as herein provided shall forfeit and pay a penalty not exceeding $100 for each offense.
This article shall take effect upon its publication as required by law.
