[Amended 2-21-2017 by Ord. No. 2-2017]
Unless another penalty is expressly provided by New Jersey statute
or except as specifically provided in some other section of this chapter,
every person convicted of a violation of a provision of this chapter
or any supplement thereto shall be liable as follows:
A. Any person violating or failing to comply with any of the provisions
of this chapter shall, upon conviction thereof, be punishable by a
fine in an amount up to $500; upon a second violation, a fine in an
amount up to $1,000; and upon a third or subsequent violation, a fine
in an amount up to $1,500; and/or a period of community service not
to exceed 10 days.
B. Any person who is convicted of violating the provisions of this chapter
within one year of the date of previous violation of the same chapter
and who was fined for the previous violation shall be sentenced by
the court to an additional fine as a repeat offender. The additional
fine imposed by the court for a repeated offense shall not be less
than the minimum or exceed the maximum fine fixed for a violation
of this chapter, but shall be calculated separately from the fine
imposed for the original violation of this chapter. Whenever such
person shall have been officially notified or by service of a summons
in a prosecution, or in any other official manner, that said person
is committing a violation, each day's continuance of such violation
after such notification shall constitute a separate offense, punishable
by a like fine or penalty.
All former traffic ordinances of the Township of Logan are hereby
repealed, except that this repeal shall not affect nor prevent the
prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.
Should any section, clause, sentence, phrase or provision of
this chapter be declared unconstitutional or invalid by a court of
competent jurisdiction, such decision shall not affect the remaining
portions of this chapter.
This chapter shall take effect immediately upon final passage
and publication in accordance with law.
