There shall be a Department of Public Works headed by a Superintendent who shall be appointed by the Mayor pursuant to the procedure as set forth in §
C4-3C. They shall be qualified on the basis of their training and experience in civil engineering and public works administration. Unless otherwise provided in this Charter, they shall be directly responsible to the Mayor.

The Superintendent of the Department of Public Works shall have
the powers and duties to:
A. Organize and supervise the activities of the Department with respect
to:
(1) Streets, public rights-of-way, sidewalks, bridges, public parking
lots and the cleaning and removal of snow and ice therefrom.
(3) Sanitary sewer system and disposal plant.
(4) Drainage ditches, creeks, streams, rivers and other watercourses
or drainage systems.
(5) Refuse collection and disposal.
B. Establish the location of all underground utilities and to order
the renewal or renovation of all private connections thereto.
C. Be responsible for the preparation of all plans and specifications
for public works and improvements undertaken by the City.
D. Provide technical and professional assistance and advice on all projects
of an engineering nature undertaken by the City.
E. Supervise the performance of all contracts for public works and improvements
and certify the amounts due and payable thereunder.
F. Provide and maintain maps, specifications, surveys and operating
records with respect to all public property, works and facilities
owned or operated by the City.
G. Propose with the Public Works Board ordinances for the regulation
of pedestrian and vehicular traffic, except as otherwise provided
by law.
H. Hire all subordinate personnel and provide their discipline in accordance
with law.
I. Perform such other duties as requested by the Mayor, or as otherwise
may be authorized.
J. Provide for the design, installation, operation and maintenance of
all fire alarm equipment within the City.

K. Provide for the design, installation, operation and maintenance of
all systems used for the transmission and distribution of electric
lighting for public streets, highways and other public places within
the City limits subject to contracts and franchises entered into between
the City and any public utility corporation.

L. Provide for the design, installation, operation and maintenance of
all signs, signals, markings and similar devices for regulating vehicular
and pedestrian traffic and parking and recommend to the Common Council
proper locations for such devices.

M. Recommend to the Common Council the adoption of appropriate ordinances
to regulate the movement of vehicular and pedestrian traffic and parking
within the City.

N. Ensure the enforcement of all ordinances relating to the regulation
and control of trees, plants and shrubs and contract for the removal
of all trees affecting the public right-of-way within the City.

O. Temporarily prohibit, limit, regulate or otherwise control traffic
upon any street or portion thereof in the event of an emergency, or
when repairs or improvements are in progress on such streets, or for
test purposes to determine the desirability of proposed traffic control
measures.

P. Provide for the performance of such other functions as required of
the Department by the Common Council.

Q. To hire all subordinate personnel and to provide for their training

The membership of the Board of Public Works shall hereafter
consist of seven members who shall be appointed by the Mayor with
confirmation by the Common Council. The members shall serve three-year
terms with no compensation, except the Common Council may authorize
compensation for expenses. The Board of Public Works shall, at the
beginning of each year, elect one of its members as Chair.

The Board of Public Works shall:
A. Submit to the Mayor the names of at least three qualified candidates, if there are three qualified candidates on the list of names reviewed and evaluated pursuant to §
C4-3C for the position of Superintendent.
B. Assist the Superintendent when requested in any personnel or disciplinary
action.
C. Review the estimates of revenues and proposed expenditures and capital
program of the Department of Public Works and make recommendations
to the Mayor and Capital Program Committee, respectively.
D. Review all complaints by citizens and, with the Superintendent, devise
solutions to valid problems in departmental operations.
E. Advise the Superintendent on the administration and operations of
the Department as they or the Mayor may request or as the Commission
deems necessary.
F. Adjudicate grievances presented by any user aggrieved by their water
bill. The Board shall have power to affirm or modify the water charge,
must state its reasons for its decisions in writing, and shall order
that a refund be paid to the grievant if its decision involves modification
of the water bill.

G. Review and resolve, if possible, any operational problems within
the Department, and any complaints by citizens, with the assistance
of the Director of Administration and Finance.

H. Counsel the Department on the administration and operations of the
Department as the Mayor or the Director of Administration and Finance
may request, or as the Board deems necessary.

I. Review the information provided by the Director of Administration
and Finance relating to personnel matters, and make recommendations
for the resolution of problems relating to such matters.

J. Review the proposed Water Department annual budget and proposed water
usage rates as presented by the Mayor and the Common Council, and
advise the Common Council on any recommended amendments to the proposed
budget or water rates.
