Except in respect to the records of the Police Department of
the Borough of Hasbrouck Heights and the records of the Municipal
Court of the Borough of Hasbrouck Heights, the Borough Clerk is the
custodian of government records of the Borough of Hasbrouck Heights.
The custodian of police records shall be such officer of the
Police Department of the Borough of Hasbrouck Heights as may be designated
and assigned from time to time by the Chief of Police.
The custodian of Municipal Court records shall be such officer
of the Municipal Court of the Borough of Hasbrouck Heights as may
be designated and assigned from time to time by the Municipal Judge.
It shall be the duty of each of the aforesaid custodians of
records to permit the inspection, examination and copying of those
records in his or her custody as required in N.J.S.A. 47:1A-5.
For the purposes hereof, "government records" shall be as the
same are defined in N.J.S.A. 47-1A-1.1 excepting therefrom the following:
A. Government records classified as "confidential" under the aforesaid
statutory definition.
B. Victims' personal identifying information as defined in N.J.S.A.
47:1A-2.2.
C. Records of investigations in progress in accordance with N.J.S.A.
47:1A-3.
D. Records exempted from public access by any other statute, by regulation
promulgated pursuant to any other statute or order of the Governor,
by executive order of the Governor, by Rules of Court, or by any federal
law, regulation or order.
E. Personnel or pension records as defined in N.J.S.A. 47:1A-10.
The fees that may be charged in connection with copying records shall be as set forth in §
133-6.1 entitled "Fees under Chapter
61, Records, Open Public" of Chapter
133, Fees, of the Code of the Borough of Hasbrouck Heights.
