The Town Meeting shall, by resolution, set a bid limit which shall
stay in effect until modified. Except as otherwise provided in this
chapter, all requisitions for expenditures over the bid limit shall
require sealed bids, based upon specifications prepared at the direction
of the First Selectman, Board of Education or a Public Building Committee,
as applicable. Invitations to bid shall be published at least 10 days
prior to the opening of said bids in a newspaper having a substantial
circulation in the Town and in such other publications as the Town
may choose. Said bids shall be sealed and filed by bidders and shall
be opened and read aloud at a place, date and time specified in the
bid requests. All bid invitations must state that the First Selectman,
Board of Education or Public Building Committee, as applicable, may
reject any and all bids if, in his/its opinion, it is in the best
interests of the Town so to do. If the lowest bid meets all specifications
and is not acceptable to the First Selectman, Board of Education or
Public Building Committee, as applicable, the matter must be referred
to the Board of Selectmen for its decision on whether to reject all
bids or to accept a higher bid or such other action as it may deem
advisable.
The Board of Selectmen may waive the provisions of this chapter pertaining
to bid requirements and may authorize a negotiated contract or a shortened
notice schedule if deemed by it to be in the best interest of the
Town. The Board of Selectmen may also authorize bidding utilizing
a restricted list of bidders if deemed in the best interest of the
Town. In the case of licensed professionals, such as but not limited
to architects, lawyers and engineers, bidding shall not be required
but services and fees shall be negotiated.
Bulk items such as road salt, fuel, oil, clerical supplies and other
similar items which may be delivered at intervals may be bid on a
unit measure basis. The Board of Education may request the First Selectman
to act for it in the making of such bulk purchases.
The First Selectman shall, on or before the first day of July of
each year, obtain quotes of hourly rates for equipment and labor from
contractors desiring to do business with the Town of Bethany. Each
such hourly rate schedule shall be binding upon the submitting contractor
for one fiscal year or until another submission is requested.
The Board of Selectmen may authorize the purchase without bid on
contracts for goods or services which have been awarded by the State
of Connecticut Department of Administrative Services Bureau of Purchases
where the bidder has warranted to the state that the prices, terms
and conditions will be extended to all political subdivisions within
the State of Connecticut or certain districts or counties within the
State of Connecticut.
Advertising for all products and services shall include, in addition
to any other appropriate media sources or publications determined
by the Board, public ads in any publication of substantial circulation
in Bethany, within available appropriations, or on the internet or
Town website and the State of Connecticut Department of Administrative
Services.
