No person having possession, custody or control of any animals shall knowingly or negligently permit any dog or other animal to commit any nuisance, i.e., defecation or urination, upon any gutter, street, driveway, alley, curb or sidewalk in the Borough of Trainer, or upon the floors or stairways of any building or place frequented by the public or used in common by the tenants, or upon the outside walls, walkways, driveways, alleys, curbs or stairways of any building abutting on a public street or park, or upon the grounds of any public park or public area, or upon any private property other than the property of the owner of such animal.

A. 
Any person having possession, custody or control of any dog, cat or other animal which commits a nuisance, i.e., defecation or urination, in any area other than the private property of the owner of such dog, cat or other animal, as prohibited in § 70-14 shall be required to immediately remove any feces or animal waste from such surface and either:
(1) 
Carry same away for disposal in a toilet; or
(2) 
Place same in a nonleaking container for deposit in a trash or litter receptacle.
B. 
Every owner, tenant and/or possessor of real property in Trainer Borough shall be required to remove any feces or animal waste on such private property owned, rented by and/or possessed by each owner, tenant and/or possessor within 24 hours following the occurrence of the defecation or excretion and either:
(1) 
Carry same away for disposal in a toilet; or
(2) 
Place same in a nonleaking container for deposit in a trash or litter receptacle.
The provisions of §§ 70-14 and 70-15 hereof shall not apply to a guide dog accompanying any blind persons or to a dog used to assist any other physically handicapped person.

A. 
Any person, firm or corporation who shall violate § 70-14 and/or § 70-15A shall, upon conviction thereof, be sentenced to pay a fine of not more than $300 or to imprisonment for a term not to exceed 90 days.
B. 
Any person, firm or corporation who shall violate § 70-15B shall:
(1) 
Upon the first violation, receive a written notice and warning from the Borough police, officer, animal control officer or other agent designated by the Borough.
(2) 
Upon a second violation committed within a period of six months after the first violation and upon conviction of such second violation in a proceeding before a Magisterial District Judge, be sentenced to pay a fine of not more than $50, plus costs of prosecution, and, in default of payment of fine and costs, shall be sentenced to imprisonment for not more than 30 days.
(3) 
Upon a third violation committed within a period of six months after the second violation and upon conviction of such third violation in a proceeding before a Magisterial District Judge, be sentenced to pay a fine of not more than $100, plus costs of prosecution, and, in default of payment of fine and costs, shall be sentenced to imprisonment for not more than 30 days.
(4) 
After the third violation, upon any subsequent violation committed within a period of six months after the previous violation and upon conviction of such subsequent violation in a proceeding before a Magisterial District Judge, be sentenced to pay a fine of not more than $600, plus costs of prosecution, and, in default of payment of fine and costs, shall be sentenced to imprisonment for not more than 30 days.
(5) 
Each day's failure to comply with any such provision shall constitute a separate violation.
