For purposes of this chapter, the following definitions shall apply.
RESIDENTIAL AREA
Any real property within the Town limits which is located within a residential zoning district.
YARD SALE
Any sale of goods or items conducted in a residential area open to the public. The term "yard sale" shall include all sales entitled "yard sale," "lawn sale," "attic sale," "rummage sale" or "garage sale," "porch sale," "tag sale," etc., or any other such sales conducted on private property. The term "yard sale" does not include the sale of self-produced fresh fruit and vegetables by the producer, at either the producer's property or another property with written permission from the property owner, from a nonpermanent structure that is removed at the end of the growing season.

A. 
No person shall conduct a yard sale within the Town without first filing with the Town office the information required and obtaining a yard sale permit from the Town office.
B. 
A permit shall not be issued to the same applicant or for the same property more than four times within any calendar year.
C. 
A yard sale permit shall not be valid for more than two days.
The following information must be filed with the Town office on a form provided along with a permit fee of $2 before a yard sale permit may be issued:
A. 
The name of the person conducting the sale. If the sale is being held for or on behalf of a group or organization, there must be an individual applicant listed on the permit. The applicant will be responsible for following the procedures outlined in this chapter.
B. 
Written consent of the owner if the applicant is a tenant in possession of the property on which the sale is to be conducted.
C. 
Location at which the sale is to be conducted.
D. 
The date of the sale.
A. 
No person shall conduct a yard sale within any commercial zoning district.
B. 
A yard sale permit must be prominently displayed on the premises upon which the yard sale is conducted throughout the entire period of the sale.
C. 
Temporary signage is permitted to advertise a yard sale as long as it placed on private property with the permission of the property owner. Temporary signage shall consist of not more than two signs with a size of not more than four square feet. Temporary signage may not be displayed more than seven days prior to the commencement of the sale and must be removed within 24 hours after the conclusion of the sale.
D. 
No yard sale shall be held in such a way as to impede the orderly flow of traffic in the Town or to obstruct the ingress and egress of surrounding property owners.
E. 
A yard sale shall occur only between daylight hours.
Violations of the provisions of this chapter shall be punishable as a municipal infraction as provided in Chapter 1, Article I. Each day that a sale is conducted in violation of this chapter shall constitute a separate offense.
