This article shall provide the method for administration and enforcement of the fire prevention regulations contained in the New York State Uniform Fire Prevention and Building Code in the Village of Washingtonville and further establishes powers, duties and responsibilities in connection therewith.
Performance of inspections.
The Code Enforcement Officer and/or the Fire Marshal or any deputy shall conduct periodic firesafety inspections of existing buildings, structures or premises for compliance with the provisions of the New York State Uniform Fire Prevention and Building Code according to the following schedule:
An inspection of a building or dwelling shall be performed at any time upon the request of the owner or occupant or upon the receipt of a written complaint specifying conditions failing to comply with the New York State Uniform Fire Prevention and Building Code.
The owner, lessee, tenant, manager or operator of any building or premises shall permit the Code Enforcement Officer, Fire Marshal or any deputy to enter and inspect his building or premises.
If entrance to make an inspection is refused or cannot be obtained, the Code Enforcement Officer or Fire Marshal may apply to any court of competent jurisdiction for a warrant to make an inspection.
In the case of an emergency, the Code Enforcement Officer or Fire Marshal may, without a warrant, enter any premises or parts of premises to inspect the same, at any time, without the permission of the person in possession or occupancy.
