As used in this Chapter, the following terms shall have these
prescribed meanings:
GARBAGE
Putrescible animal and vegetable wastes resulting from the
handling, preparation, cooking and consumption of food.
LITTER
Garbage, refuse and rubbish as defined herein and all other
waste material which if thrown or deposited as prohibited by this
Chapter, tends to create a danger to public health, safety and welfare.
OWNER
Any person, firm or corporation who, alone, jointly or severally
with others, shall be in ownership of, or have charge, care or control
of, any dwelling or commercial unit within the City as owner, employee,
or agent of the owner, or as trustee or guardian of the estate of
person of the title holder, and such person shall be bound to comply
with the provisions of this Chapter to the same extent as the owner.
REFUSE
All putrescibles and non-putrescible solid wastes (except
body wastes), including garbage, rubbish, ashes, street cleanings,
dead animals, solid market and industrial wastes; wrecked, dilapidated,
disabled or derelict motor vehicles, including automobiles or any
part thereof which do not meet the safety standards for maintenance
and operation, as provided under the Statutes of the State of Missouri.
The terms "wrecked", "dilapidated", and "disabled" as used in this Chapter shall mean any motor vehicle, or automobile
or part thereof, which is found lacking essential component parts
which prevent it from being immediately operable and mobile under
its own source of power. This definition as related to motor vehicles
shall not apply to any licensed motor vehicle repair or storage facility.
RUBBISH
Non-putrescible solid wastes consisting of both combustible
and non-combustible wastes, such as paper, cardboard, tin cans, yard
clippings, ashes, wood, glass, bedding, crockery and similar materials.

A. Throwing, Etc. Upon Streets, Etc. No person shall throw
or deposit litter in or upon any street, sidewalk or other public
place within the City except in public receptacles, or in authorized
private receptacles for collection.
B. Placing In Receptacles So As To Prevent Scattering. Persons
placing litter in public receptacles or in authorized private receptacles
shall do so in such a manner as to prevent it from being carried or
deposited by the elements upon any street, sidewalk or other public
place or upon private property.
C. Sweeping, Etc., Accumulation Of Littler Into Gutters, Etc. No person shall sweep into or deposit in any gutter, street or other
public place within the City the accumulation of litter from any building
or lot or from any public or private sidewalk or driveway.
D. Abutting Owners To Keep Sidewalks Free Of Litter. Persons
owning or occupying property shall keep the sidewalk in front of their
premises free of litter.
E. Merchants To Keep Sidewalks Free Of Litter. Persons owning
or occupying places of business within the City shall keep the sidewalk
in front of their business premises free of litter.
F. Throwing, Etc. From Vehicle. No person, while a driver or
passenger in a vehicle, shall throw or deposit litter upon any street
or other public place within the City, or upon private property.
G. Throwing, Etc. In Parks. No person shall throw or deposit
litter in any park within the City except in public receptacles and
in such a manner that the litter will be prevented from being carried
or deposited by the elements upon any part of the park or upon any
street or other public place. Where public receptacles are not provided,
all such litter shall be carried away from the park by the person
responsible for its presence and properly disposed of elsewhere as
provided by this Chapter.
H. Depositing, Etc., On Occupied Private Property. No person
shall throw or deposit litter on any occupied private property within
the City whether owned by such person or not, except that the owner
or person in control of private property may maintain authorized private
receptacles for collection in such a manner that litter will be prevented
from being carried or deposited by the elements upon any street, sidewalk
or other public place or upon any other private property.
I. Depositing, Etc., On Vacant Private Property. No person
shall throw or deposit litter on any open or vacant private property
within the City whether owned by such person or not.
J. Litter Blowing, Etc., From Loaded Trucks, Etc. No person
shall drive or move any truck or other vehicle within the City unless
such vehicle is so constructed or loaded as to prevent any load, contents
or litter from being blown or deposited upon any street, alley or
other public place; nor shall any person drive or move any vehicle
or truck within the City, the wheels or tires of which carry onto
or deposit in any street, alley or other public place mud, dirt, sticky
substances, litter or foreign matter of any kind.
K. Premises To Be Kept Free Of Litter. The owner or person
in control of any private property shall at all times maintain the
premises free of litter; provided however, that this Chapter shall
not prohibit the storage of litter in authorized private receptacles
for collection.

A. Persons
owning or occupying property shall place all garbage and trash in
proper receptacles with a tight fitting lid. The receptacle may be
either plastic or metal and the size shall be between a twenty (20)
gallon and thirty-five (35) gallon container.
B. Persons
shall place yard wastes only in biodegradable bags or containers with
a lid securely attached. Yard wastes shall not be placed in a plastic
bag of any type. Garbage and refuse shall not be placed in a plastic
bag except when the entire plastic bag is placed within a proper receptacle
with a tight fitting lid.
C. Persons
owning or occupying property shall keep all garbage and trash out
of sight behind the building line before dusk of the evening preceding
garbage and trash collection. After garbage and trash has been collected,
the containers must be removed from the street area as soon as possible
after collection, but not later than Midnight of the day of collection.

Each day's violation of, or failure, refusal or neglect to comply
with any provision of this Chapter shall constitute a separate and
distinct offense.

A. A resident
may use a dumpster or pod at his or her residence for a period not
to exceed fourteen (14) days.
1. The use of a dumpster or pod during this fourteen (14) day period
shall not require a permit from the Northwoods City Hall or payment
of a fee to the City of Northwoods, Missouri.
2. The resident shall notify the City of Northwoods of the date of placement
of a dumpster or pod at his or her residence within five (5) business
days. The fourteen (14) day period shall be calculated beginning with
the date on which the dumpster or pod was placed on the resident's
property.
3. The dumpster or pod shall be placed on the resident's driveway.
B. For
periods exceeding fourteen (14) days, a resident may use a dumpster
or pod at his or her residence upon receipt of a permit from the City
of Northwoods City Hall.
1. A dumpster or pod permit shall be valid for a period of thirty (30)
days and may be renewed for two (2) additional thirty-day periods
upon approval of the administration at the Northwoods City Hall if
construction is still pending.
2. A dumpster or pod permit shall cost fifty dollars ($50.00). Each
additional permit shall be renewed at a cost of fifty dollars ($50.00).
C. All
pods and dumpsters shall state the full name and phone number of the
company providing said pod or dumpster.
D. All
pods or dumpsters shall be equipped with a cover/lid that completely
covers the items therein.
1. Pods and dumpsters shall be covered when moved.
2. Residents must not allow their respective pod or dumpster to become
so full that they are unable to properly close.
3. Residents must empty their respective pod or dumpster timely and
regularly to avoid any overflow or spillage.
E. If
the resident has a driveway, the pod or dumpster shall be placed on
the resident's driveway.
F. If
the resident does not have a driveway, the pod or dumpster may be
placed on the street under the following conditions:
1. No pod or dumpster shall block the flow of traffic or create a safety
hazard within the residence.
2. No pod or dumpster shall be located within forty (40) feet of a bus
stop, twenty (20) feet of a disabled parking spot, twenty (20) feet
from a crosswalk, thirty (30) feet of an intersection or fifteen (15)
feet of a fire hydrant.
3. The resident shall obtain a permit under Subsection
(B) of this Section.
G. At
no time may a pod or dumpster be placed on the grass.
H. All
pods and dumpsters must be accessible from the property being emptied
or renovated.
I. At
no time may a pod or dumpster contain yard waste or hazardous materials.
J. The
City of Northwoods City Hall reserves the right to place restrictions
on the placement, size or time limit of the use of a pod or dumpster
at all times.
K. A resident
found to be in violation of any part of this Section shall be subject
to all penalties within the law.
