No person shall conduct commercial audiovisual productions on
any property owned or maintained by the Town of Cornwall without first
obtaining a commercial audiovisual production permit under this chapter.
No such permit shall be required for commercial audiovisual productions
conducted on private property.
All applications for commercial audiovisual production permits
shall be made to the Town Board and shall include the following information:
A. The name, address and telephone number of the applicant or sponsor.
B. The name of the person or persons who will be in charge of conducting
the audiovisual production and contact information for the same, such
as a cellular telephone number.
C. A brief description of the proposed audiovisual production.
D. Whether, and to what extent, any assistance from Town police or other
municipal employees will be required for the event, including crowd
control, closing of roadways, etc.
E. A description of the plans for security, crowd control and first
aid.
F. A description of the plan for trash receptacles, trash removal and
clean up.
Applications for permits for commercial audiovisual production
are to be made at least 30 days prior to the proposed date for the
commercial audiovisual production; provided, however, the Town Board
may waive this requirement and accept applications on such lesser
time frames as it may deem appropriate.
It shall be a condition of all permits issued that the applicant
must provide the Town with a certificate of liability insurance naming
the Town of Cornwall as a named additional insured with coverage in
the following minimum amounts, provided that the Town Board is authorized
to change the above-listed coverage amounts by resolution:
A. Property damage: $2,000,000 per individual; $2,000,000 per occurrence.
B. Personal injury: $2,000,000 per individual; $2,000,000 per occurrence.
In determining whether to grant applications for commercial
audiovisual production permits, the Town Board shall consider the
following criteria:
A. The extent, if any, to which the proposed commercial audiovisual
production will impact traffic on local roadways and community resources
such as police and fire protection.
B. The extent, if any, to which the proposed commercial audiovisual
production will be detrimental to nearby properties and the neighborhood,
including noise, light, visual and other environmental impacts.
C. Whether the plans for traffic circulation, parking, security, crowd
control, first aid, sanitary facilities, and trash receptacles and
removal are adequate.
In granting a commercial audio visual production permit, the
Town Board may attach reasonable conditions to such permit.
Applications for commercial audiovisual production permits shall
be subject to payment of a fee to the Town in such amounts as the
Town Board may establish by resolution in order to cover the Town's
reasonable review and processing the application and hosting the commercial
audiovisual production; provided, further, that the Town Board may,
in its discretion, reduce or waive said fees by resolution upon good
cause shown.
If an audiovisual production permit is issued and, due to inclement
weather or other good cause, the audiovisual production does not take
place on the date specified, the Town Clerk, upon receiving certification
that the production did not take place, may issue a new permit for
other dates. The Town shall not require an additional fee for this
permit.
