Any person, firm, or corporation desiring to cut into or make
excavation under any improved surface of any type, in any public street
or alley in the City, shall first make application to the City Clerk
for permit therefor; setting out the location and probable extent
of such cutting or excavation, giving the reason therefor, and shall
file bond with the City in the sum of one thousand dollars ($1,000.00),
to protect said City against all claims of any character which might
arise on account of such cuttings or excavations; provided however,
no such additional bonds shall be required from plumbers or drain-layers
who have such proper bonds on file. The City Clerk shall then file
said application and bond in his/her office.

In all cuttings of improved surfaces care shall be taken to
avoid damaging the adjoining surface. Proper barricades shall be maintained
and lights placed at same so long as said openings shall remain open
and until the improved surface shall have been replaced and fit for
traffic all at the sole expense of such person, firm or corporation
which made such cutting or excavation.

In filling all excavations and cuttings under or into any improved
surface, the soil thereunder shall be thoroughly tamped to a point
even with the adjoining surface. In all cases in replacing improved
surface where the cut therein is more than one (1) square foot in
extent, the edges of the adjoining surface shall be cut back to a
distance of eighteen (18) inches beyond the edges of the cut which
has been made.

In the case of cement surface the repair shall be made over
a six (6) inch crushed and compacted aggregate base. The base shall
be limestone or some other material acceptable to the Street Superintendent.
There shall be reinforcing steel not less than one-half (½)
inch in diameter placed eight (8) inches apart extending the full
distance across the opening; said steel to be placed atop the base.
The cement paving shall then be replaced with Portland cement which
conforms to standard specifications, ASTM Designation C-150, Type
I. The mixture of the Portland cement shall be one (1) part Portland
cement as described; two (2) parts clean sand and three and one-half
(3½) parts of clean gravel with sufficient water to make a
uniform composition and proper consistency. This shall be deposited
and well rammed and finished to the grade of the adjoining surfaces
and correspond therewith.

In the event the surface to be repaired is asphaltic concrete the base shall be prepared as that described in Section
510.040, except the reinforcing steel rods are not required. The surfaces to be repaved shall receive asphaltic primer prior to paving as directed by the Street Superintendent and the asphaltic concrete shall be of the penetration grade determined by the Street Superintendent, and shall conform to the latest revised
"Specifications for Asphalt Cements and
Liquid Asphalts" Specifications Series No. 2 (SS-2), the
Asphalt Institute.

All work of cutting and excavating of any concrete surface shall
be under the supervision of the Street Superintendent and subject
to his/her approval or rejection and all such work shall be completed
without delay or interruption.

Any person, firm or corporation who shall violate any part of
this Chapter shall be deemed guilty of a misdemeanor.
