This chapter shall be known as the "Borough of Kane Engine Brake Ordinance."
No gasoline- or diesel-powered motor vehicle shall be operated from the Borough line on Wood Street/Biddle Street (SR 0006) to the Borough line on North Fraley Street; from the Borough line on SR 0321 south to the Borough line on Hacker Street (SR 0321 North); from the Borough Line on South Fraley Street (SR 0066) to Greeves Street; or any other Borough street approved by PennDOT for this restriction within the Borough of Kane, McKean County, Pennsylvania, utilizing, in said operation, an engine brake, with or without exhaust mufflers or with defective or modified exhaust mufflers permitting excessive noise to be created by said motor vehicle.
This chapter shall not apply to emergency driving situations requiring the utilization of an engine brake to protect the safety and property of the residents of Kane Borough, other motor vehicle operators, pedestrians and the operator and passengers of the motor vehicle involved in said emergency situation.
Any person, firm, corporation or organization violating any of the provisions of this chapter shall, upon summary conviction before a District Magistrate having jurisdiction, be sentenced to pay a fine of not more than $600 and costs of prosecution, and in default of the payment thereof, shall be sentenced to undergo imprisonment in the McKean County Prison for a period of not to exceed 90 days.
