There is hereby adopted by the Borough of Darby, for the purpose
of establishing housing hygiene standards, that certain manual known
as the "Housing Hygiene Standards for Pennsylvania," being particularly
the June 27, 1968, Edition thereof and the whole thereof, and the
amendments thereto dated February 28, 1969, of which not less than
three copies have been and now are filed in the office of the Secretary
of the Borough of Darby, and the same are hereby adopted and incorporated
as fully as if set out at length herein, and from the date on which
this chapter shall take effect, the provisions thereof shall be controlling
with regard to establishing housing hygiene standards for all buildings
and structures contained within the corporate limits of the Borough
of Darby. However, the Pennsylvania Building Regulations of the Commonwealth
of Pennsylvania and the Building Code of the Borough of Darby will take precedence over these standards wherever applicable,
and the provisions of all other regulations of the Department of Labor
and Industry of the Commonwealth of Pennsylvania shall be applied
in all matters not specifically covered by these standards or regulations
promulgated thereunder.
Nothing in this chapter or in the Housing Hygiene Standards
for Pennsylvania manual hereby adopted shall be construed to affect
any suit or proceeding now pending in any court, or any rights acquired
or liability incurred, nor any cause or causes of action accrued or
existing, under any act or ordinance repealed hereby. Nor shall any
right or remedy of any character be lost, impaired or affected by
this chapter.

Any person who shall violate any provisions of this chapter
or the Housing Hygiene Standards for Pennsylvania adopted hereby shall,
upon conviction thereof, be punishable by a fine of not more than
$300 and costs of such proceedings or, upon default of payment of
such fines and costs, by imprisonment in the county jail for a term
of not more than 30 days. The continuation of such violation for each
successive day shall constitute a separate offense, and the person
or persons allowing or permitting the continuation of the violation
may be punished as provided above for each separate offense.
