A person who has been arrested for operating a motor vehicle under the influence of an alcoholic beverage, any chemical substance, and/or any controlled dangerous substance in violation of N.J.S.A. 39:4-50 shall be held in protective custody by the Lawrence Township Police Department until such time as the person is no longer a danger to himself or others.
A. 
Any person placed in protective custody pursuant to § 83-26 shall be held in the Lawrence Township municipal lockup or other facility where the person's condition may be monitored until a determination is made that the person is no longer a danger to himself or others.
B. 
For the purposes of this section, the term "other facility" shall mean a medical facility where the person may be detained in a medically acceptable manner and their condition monitored by Police and/or medical personnel.
A. 
A person arrested for violating N.J.S.A. 39:4-50 may be released from protective custody at such time as they are no longer a danger to himself or others.
B. 
A person will be deemed to be no longer a danger to himself or others when their blood alcohol concentration is less than 0.05% and is no longer under the influence of any intoxicating liquor or narcotic or hallucinogenic or habit-forming drug to the extent their facilities are no longer impaired.
C. 
In no event shall a person being held in protective custody pursuant to § 83-26 be held for longer than eight hours without an appropriate hearing before a Municipal Court Judge.
Notwithstanding the provisions of this section, a person being held in protective custody pursuant to § 83-26 may, because of age, health or their own safety, be released pursuant to the provisions of N.J.S.A. 39:4-50.22 et seq., or be provided with a reasonable alternative to protective custody provided that the Police Department determines that the person's release would not be a detriment to public safety.
