[Derived from Ch. 20, Art. III, Div. 2, of the 1971 Code]
No person, firm or corporation shall directly discontinue use of, disconnect or abandon, or, alternatively, knowingly allow or permit any such discontinuance, disconnection or abandonment by others for more than three years, on premises under its ownership or control, of any cesspool, septic tank or other similar or appurtenant subsurface private sanitary facilities within the Township without first applying for and obtaining a permit therefor from the Township Plumbing Subcode Official.
A. 
The Township Plumbing Subcode Official shall prescribe the form of such application and permit, and shall issue and enforce same in accordance with rules and regulations to be prescribed by him in accordance with law, and in conformity with such applicable regulations and standards as may be prescribed or recommended by the Division of Water Policy and Supply of the State Department of Conservation and Economic Development, by the State Department of Health and Senior Services and by other agencies having jurisdiction.
B. 
In the absence of applicable State standards and recommendations, the Township Health Officer may prescribe such rules and regulations in accordance with the following criteria:
(1) 
The safety of persons on the surface in or about the facilities abandoned or to be abandoned.
(2) 
Prevention of contamination or pollution of the subsurface or percolating waters of the Township.
(3) 
Prevention of disease and otherwise insuring the public health, safety and welfare of the residents of the Township.
There shall be a fee paid upon the filing of any such application prescribed for in this article which may be found in Chapter 156 of this Code.

A. 
Any person, firm or corporation violating any of the provisions of or any order promulgated under this article shall, upon conviction, be liable for the penalty stated in Chapter 1, Article III.
B. 
Each day a particular violation continues shall constitute a separate offense.
