As used in this chapter, the following terms shall have the meanings indicated:
BOARD
The Board of Park and Recreation Commissioners.
GATHERING
An organized and preplanned assembly of persons participating in a common activity or event.
LITTER
All waste material which, if thrown, scattered or deposited, tends to create an unsightly condition or a danger to public health, safety and welfare.
PARK
An area of land, with or without water, developed and used for public recreational purposes, including landscaped tracks; picnic grounds; playgrounds; camps; foot, bicycle and bridle paths; motor vehicle drives; wildlife sanctuaries; museums; zoological and botanical gardens; and facilities for bathing, boating, hunting and fishing, as well as other recreational facilities for the use and the benefit of the public.
RECREATION AREAS
Those public lands owned by the Borough and designated by the Borough as limited-use facilities based upon their primary use as passive recreation areas located within Rindlaub Park.
RECREATION FACILITIES
Improved facilities, including athletic fields (including but not limited to baseball, soccer, football and lacross fields), tennis courts and other hardscape non-natural attractions constructed within Rindlaub Park, other than open grassy areas, walking paths, benches and picnic tables.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn.
A. 
There is created, pursuant to N.J.S.A. 40:12-1 et seq., a Board of Park and Recreation Commissioners ("Commission") of the Borough consisting of seven members. The members shall be appointed by the Mayor, with the advice and consent of the Council. There may be one member of the Council on the Board of Park and Recreation Commissioners, who shall be appointed annually by the Mayor, with the advice and consent of the Council, for a term of one year. All of the members of the Board shall be citizens and residents of the Borough.
B. 
The Commissioners first appointed shall be appointed for terms of one, two, three, four and five years, respectively, and the additional Commissioners shall be appointed one for four and one for five years. Thereafter, all appointments shall be for the term of five years, and vacancies shall be filled for the unexpired term only. The members shall serve until their respective successors are appointed and shall qualify.
C. 
No Commissioner shall receive any compensation for his services as a Commissioner.
A. 
Immediately following their appointment and assumption of their office, an organizational meeting shall be held by the members of the Board. At such time, there shall be elected a Chairman and a Vice Chairman, who must be Commissioners, a Secretary, who need not be a Commissioner, and such officers as may be necessary.
B. 
It shall be the duty of the Chairman to preside at all meetings of the Board and of the Secretary to keep minutes at all the meetings and of all the proceedings of the Board. A majority of the Board shall constitute a quorum of business, and four affirmative votes shall be necessary to carry any proposition. A meeting of the Board shall be held at least once in every three months.
The Board of Park and Recreation Commissioners shall at all times be subject to the general authority of the Mayor and Council but shall have the following powers, duties and authority:
A. 
With the approval of the Council, given after appropriate action in accordance with the laws of the state, to acquire lands for public parks and recreation places by gift or purchase and to construct or cause to be constructed on these lands so acquired such buildings or other structures as may be deemed necessary to enable the Board to provide properly and adequately for the purposes of the Board.
B. 
By and through the Mayor and Council, to solicit and receive any gifts or bequests of money or other personal property to be applied for either the temporary or permanent operation and maintenance of the parks and recreation areas within the jurisdiction of the Board.
C. 
To conduct and/or approve any form of recreation and cultural activity that will benefit the health, education and general welfare of the residents of the Borough.
D. 
To control and supervise all parks and places of recreation within the jurisdiction of the Borough.
E. 
To adopt suitable rules, regulations and bylaws governing both the use of such parks and recreation areas and the conduct of all persons while on or using the same.
A. 
All rules, regulations, bylaws and amendments thereto adopted by the Board shall be promulgated by one publication in a newspaper published or circulated in the Borough, and a notice shall be posted in at least one public place and at each location in the Borough to which they apply.
B. 
This chapter and the rules and regulations adopted by the Board shall be enforced by the Police Department of the Borough.
C. 
These rules and regulations shall become effective 10 days from and after the date of the last publication.
D. 
A violation of the rules, regulations and bylaws adopted by the Board shall be deemed a violation of this chapter.
A. 
Each year the Board shall develop an operating budget for the ensuing calendar year and present it to the Council on or before November 1.
B. 
The budget shall give the details of the moneys considered necessary to carry out the park and recreational programs adopted by the Board and shall show the amount of moneys allocated for the various required services. The Council shall have the right to approve the budget in whole or in part or to fix an amount which the Council deems adequate and proper for the purpose of the Board of Park and Recreation Commissioners and shall appropriate the sum for such purpose. The Board shall have the right to conduct its affairs, policies and programs and to expend moneys each year within the amount appropriated by the Council for such purpose. At no time shall the Board expend more than the sum so appropriated.
C. 
Each year the Board may make recommendations to the Council concerning capital improvements to any Borough park; but, in accordance with the laws of the state, the Council shall retain control over the expenditures of any moneys appropriated for such capital improvements.
A. 
The recreation areas shall be open to the general public, subject to regulation of hours of operation and closure for special events. Subject to rules and regulations promulgated by the Park and Recreation Commission, recreation facilities shall generally be available in the first instance for residents of the Borough of Saddle River and those participating in events authorized by the Commission.
B. 
Any group or organization seeking to conduct or sponsor an event or gathering at any recreation area or facility shall in the first instance make application to the Commission, which shall review and process such applications on a first-come-first-served basis.

A. 
No person shall do or commit any of the following acts or things in a playground or recreation areas:
(1) 
Except with permission of the Borough or Commission, operate a vehicle or ride in or upon the same except on an established road or way.
(2) 
Operate a vehicle on an established road or way at a speed in excess of 10 miles per hour.
(3) 
Kill, injure or disturb any animal or bird or damage any tree, shrub, grass or plant or damage any building, sign, structure or equipment, except as may be permitted by the Borough or Commission.
(4) 
Use any firearms, explosives, air rifles, slingshots or any other weapon, except as may be provided by law.
(5) 
Throw, scatter or deposit any litter, except in receptacles provided for the same.
(6) 
Use any loud, violent, obscene or profane language or conduct oneself in a disorderly or obscene manner or commit any nuisance.
(7) 
Break, throw or place any glass on the lawns, walks, roads, benches, tables or other areas.
(8) 
Disturb or interfere with any improvements under construction or about to be constructed.
(9) 
Enter any area in disregard of signs or posted notices forbidding the same.
(10) 
Skate upon any ice except when a sign shall indicate it is safe to do so.
(11) 
Give entertainment of any kind or transact business of any kind or hold public gatherings, meetings or assemblies without the prior written permission of the Council or its representative. The Board may give priority use to a gathering, provided that an application has been made by the sponsor of such gathering in advance and the fee contemplated by § 154-9 of this chapter has been paid.
(12) 
Place any signage of commercial advertising in any area or attached to any facility. Temporary signage approved by the Commission is permitted.
(13) 
Permit a dog to run at large.
(14) 
Ride or lead a horse, except upon roads or trails provided for this purpose.
(15) 
Sell, vend, distribute or give away any article or merchandise whatever without the prior written permission of the Council or its representative.
(16) 
Carry, possess or dispense any intoxicating liquors, wines or beers, unless permitted to do so by the Council or its representatives.
(17) 
Permit or cause a vehicle to enter any recreational area between 1/2 hour after sunset and 1/2 hour before sunrise; provided, however, that this regulation shall not apply to emergency repairs or to normal use by the vehicle's occupants at a function being held pursuant to a permit issued by the Council or its representative or approved application by the Commission.
(18) 
Use roads or ways for the purpose of demonstrating any vehicle or for the purpose of instructing another to operate any vehicle or for learning to operate any vehicle.
(19) 
Permit, take or allow any dog, whether on a leash or not, to enter or cross the pedestrian bridge or otherwise be present on the west side of the pedestrian bridge or west of the Saddle River.
(20) 
Permit any dog to kill, injure or disturb any other animal, including but not limited to waterfowl.
The Board may issue permits and charge the fees set forth in Chapter 134, Licenses and Permits, for the use of the recreation facilities of the Borough of Saddle River.
Violation of the provisions of this chapter shall be punishable as provided in Chapter 1, General Provisions, Article III, General Penalty.
