For the purpose of promoting the public health, safety, morals
and general welfare of the Village of Weedsport, the Village is hereby
divided into the following zoning districts:
A. Residential Zoning District (R) - The purpose of the Residential
Zoning District is to preserve the character and scale of the many
residential neighborhoods in the Village. The intent is to retain
single-family homes as the primary land use within the zoning district,
while allowing small-scale two-family and multifamily housing at appropriate
sites.
B. Commercial Zoning District (C) - The purpose of the Commercial Zoning
District is to promote and expand commercial development in the center
of the Village where the primary land use is commercial. The intent
is to permit appropriate commercial development and allow residential
uses primarily in the upper stories or rear of buildings when appropriate.
C. Historic Commercial Zoning District (HC) - The purpose of the Historic
Commercial Zoning District is to revitalize the historic center of
Weedsport by developing a vibrant, pedestrian-friendly central business
district. The intent is to implement design guidelines within the
historic core of the Village and permit commercial uses that are appropriate
for the historic Village center, with the addition of residential
uses. Residential uses are encouraged to be located on upper stories
or on the rear of the first floor in order to encourage buildings
in this district to maintain commercial storefronts.
D. Neighborhood Commercial Zoning District (NC) - The purpose of the
Neighborhood Commercial Zoning District is to promote mixed-use commercial
and single-family residential development to serve as a buffer between
the Historic Commercial and Commercial Zoning Districts and the Residential
Zoning District. The intent is to permit residential and small-scale
commercial uses, primarily in existing residential buildings, in order
to maintain a neighborhood residential feel.
E. Industrial Zoning District (I) - The purpose of the Industrial Zoning
District is to allow for industrial development in an area of the
Village that is not primarily adjacent to residential neighborhoods
and where the primary land use is industrial and vacant land. The
intent is to permit industrial and related land uses primarily through
special use permits, in order to mitigate any negative external impacts
that may occur due to industrial activities.
Said districts are bounded as shown on a map titled "Zoning
Map of the Village of Weedsport" which accompanies and which, with
all explanatory matter thereon, is hereby made a part of this chapter.
(See Appendix I.)
Where uncertainty exists with respect to the boundaries of any
of the aforesaid districts as shown on the Zoning Map, the following
rules shall apply:
A. Where district boundaries are indicated as approximately following
the center lines of streets or highways, street lines or highway right-of-way
lines, such center lines, street lines or highway right-of-way lines
shall be construed to be such boundaries.
B. Where district boundaries are so indicated that they approximately
follow the lot lines, such lot lines shall be construed to be said
boundaries.
C. Where district boundaries are so indicated that they are approximately
parallel to the center lines or street lines of streets or the center
lines or right-of-way lines of highways, such district boundaries
shall be construed as being parallel thereto and at such a distance
as shall be determined by the use of the scale shown on the Zoning
Map.
D. In the case of further uncertainty as to the true location of a zoning
district boundary line in a particular instance, the Zoning Board
of Appeals shall determine the location of such boundary.
