For purposes of this Chapter
14 of the City Code, the term "board" shall mean every nonelective appointed board, commission, agency, committee or advisory group established by the Common Council of the City of Peekskill.
Notwithstanding any other provision of the City Code of the City of
Peekskill on the date hereof, any board heretofore or hereafter established
by the City of Peekskill shall be required to meet at least one time in each
calendar year. For the purposes of this section, the presence of a quorum
of such board shall constitute a meeting for the discharge of the functions
of such board. In the event that any such board shall not meet at least one
time in any calendar year, any such board shall be deemed abolished as of
January 1 of the year following the calendar year in which such board or commission
did not meet. Nothing contained in this section shall be construed to abolish
any board of the City which the City is required to establish and maintain
by any federal, state or local law or any board which, by the nature of its
function, is required to meet solely in response to a particular request,
complaint or grievance.
Notwithstanding any other provision of the City Code of the City of
Peekskill, and except as otherwise required by the laws of the State of New
York or the Charter of the City of Peekskill, the term of office of any member
of a board established by the City of Peekskill shall be three years as determined
from the date of appointment; provided, however, that this provision shall
not apply to the members of the Planning Commission, Zoning Board of Appeals,
any Charter Revision Commission established by the City or any other board
for which the terms of office of its members are fixed by the laws of the
State of New York or by the City Charter.
Notwithstanding any inconsistent provision of this City Code, any member
of a board of the City of Peekskill who fails to attend three meetings of
such board in any calendar year shall be deemed to have resigned from his
or her position, and such member's position shall thereupon be deemed vacant
and shall be filled in accordance with the provisions of the City Code and
City Charter. Notwithstanding the foregoing, the duly designated chairperson
of any such board may, for good cause shown, excuse any such member from attending
any meeting, and, upon granting such excuse from attendance, absence from
said meeting shall not be considered an absence for purposes of this section.
No chairperson shall grant more than three excused absences to any member
of any board in any calendar year. The chairperson may be excused by the vice-chairperson
of such board. The provisions of this section shall apply to all boards of
the City, including but not limited to the Planning Commission, Zoning Board
of Appeals and the Industrial Development Agency of the City of Peekskill.
