The hours of operation of a food establishment with 10 tables or less subject to the provisions of this chapter and which also possesses a plenary retail alcohol consumption license pursuant to Chapter 149 of this Code shall not be earlier than 5:00 a.m., nor later than 2:00 a.m. (Monday through Friday and Sundays) or 3:00 a.m. (Saturdays), the following day. The hours of operation for all other food establishments with 10 tables or less subject to the provisions of this chapter shall not be earlier than 5:00 a.m., nor later than 12:01 a.m. the following day.
Tables which seat two persons shall be, at a minimum,
30 inches by 30 inches, and tables for four persons shall be, at a
minimum, 40 inches by 40 inches.
Any existing establishment which seeks to operate on a twenty-four-hour basis must apply to the City of Passaic for a certificate of occupancy. To obtain a certificate of occupancy for a twenty-four-hour-a-day restaurant, the applicant must comply with the requirements of § 149-43 as well as the parking requirements established by § 317-26 for food establishments.[1]
