In the event that any commercial establishment offering gasoline and/or
liquefied petroleum products for resale does not sell or offer such gasoline
and/or liquefied petroleum products for resale for a period of three months,
wherein there is no continuous business operation for at least four continuous
weeks in said three-month period as measured from the first day of nonuse,
then the owner and/or lessee of such commercial establishment shall immediately
remove the tanks and gasoline pumps from the site of the same. In lieu of
removing the tanks, said owner and/or lessee shall remove the gasoline and/or
liquefied petroleum products therefrom and fill all storage tanks with sand.
In the event that the operation of any commercial establishment offering gasoline and/or liquefied petroleum products for resale is discontinued for a period of three years after the effective date of this article, wherein there is no continuous operation for a period of at least three continuous months out of said three-year period, then the same shall be considered as abandoned, and all buildings shall be removed and the property leveled, graded, landscaped and seeded. This section shall not be applicable where any such commercial establishment has been converted to a use permitted by Chapter 205, Zoning, as the same shall exist now or as the same shall be amended from time to time.
In the event of failure to comply with any of the foregoing within 30
days after the issuance of a written directive to do so by the Board of Trustees
of the Village of Ballston Spa, then the Village of Ballston Spa may take
such steps as it deems necessary to enforce these conditions and add all costs
and expenses thereof incurred therein to the next annual tax bill covering
the property on which said commercial establishment is located and collect
the same in the same manner as unpaid taxes.
In the event that there exists any commercial establishment within the Village of Ballston Spa which formerly offered gasoline and/or liquefied petroleum products for resale and is not now offering gasoline and/or liquefied petroleum products for resale at the present time, the time limitations contained in §§ 129-1 and 129-2 above commence to run upon the effective date of this article.
