Authority is hereby vested in the Chief of Police of the Borough, in conjunction with the recommendations of the Chief of the Fire Department, Fire Official and the Zoning Official, to establish and designate fire and emergency access lanes in and around parking yards and parking places which are open to the public or to which the public is invited in the Borough.
The fire and emergency access lanes may include but are not limited to any parking or no-standing areas, traffic directional lanes and areas designated solely for pedestrian traffic. The fire zones to be established pursuant to § 131-1 shall be designated in such areas of such public properties as will ensure fire equipment and other emergency vehicles unobstructed means of ingress, egress and operation to such properties in the event of fire or other emergency.
A. 
The fire and emergency access lanes shall be in those locations and of sufficient design as may be reasonably required by the public safety officials.
B. 
The purpose of these lanes is to guarantee unimpaired ingress and egress in and around public parking areas and to and around all buildings located in these areas in the event of fire or other emergency for police, fire and other emergency vehicles.
C. 
Such lanes shall be installed by the property owner with acceptable signs and paint on the pavement provided by such property owner and installed and maintained under the guidance and direction of the Chief of Police, the Fire Chief and the Fire Official of the Borough.
D. 
The number, location, width, length and markings of such fire lanes shall be determined by the Police Chief, the Fire Chief and the Fire Official of the Borough.
E. 
Signs and lighting for such lanes and the means of ingress to and egress from such lanes shall be determined according to standards as established by the municipality pursuant to N.J.S.A. 40:48-2.46 and shall, in any event, conform to all those requirements as set forth in Title 39 of the Revised Statutes of New Jersey.
No person, firm or corporation or any of their agents or employees, shall leave standing or cause to be parked any vehicle in any of the aforementioned lanes nor cause any other obstruction in these designated lanes.
This chapter shall be enforceable by any member of the Borough Police Department, Fire Chief or the Fire Official of the Borough. Summons for violation of this chapter may be served upon a defendant by affixing it to the vehicle involved in the violation. In the event that such violation represents an immediate hazard to the safeguard of the public safety and welfare, the enforcing officer may, at his discretion, have such vehicle or obstruction removed. The person, persons or corporation responsible for such violation thereof would pay the reasonable cost.
Any person violating any of the regulations to be promulgated pursuant to this chapter shall, upon conviction thereof, be punishable as provided in Chapter 1, § 1-16, of this Code. The Judge may also consider whether or not such person is responsible for or has paid the reasonable fees for the removal of any such object or vehicle in violation of this chapter.
