The office of Borough Administrator is hereby created, and the employment of the Borough Administrator is hereby authorized under the authority of N.J.S.A. 40A:9-136 et seq.

Appointment to the office of Borough Administrator shall be made by the Mayor with the advice and consent of the Borough Council. The term of office of the Borough Administrator shall be at the pleasure of the Mayor and Council. A person appointed to the office of Administrator shall not be required to be a resident of the Borough of Franklin.
The Borough Administrator shall receive compensation to be fixed by the Mayor and Council pursuant to the Borough's Salary Ordinance.
Any vacancy in the office of the Borough Administrator shall be filled by the Mayor with the advice and consent of the Council.
During the absence or disability of the Borough Administrator, the Mayor and Council may, by resolution, appoint an interim Administrator to perform such duties of the Borough Administrator during the Administrator's absence or disability. Unless otherwise prescribed by law, such absence or disability shall be limited to three months, after which time such absence or disability may be deemed a vacancy.
The Borough Administrator shall not engage in any other occupation or employment, except such other positions or duties as may be authorized by the Mayor and Council.
The Borough Administrator may be removed by 2/3 vote of the Mayor and Council. The resolution of removal shall become effective three months after its adoption by the Mayor and Council. The Mayor and Council may provide that the resolution shall have immediate effect; provided, however, that the Mayor and Council shall cause to be paid to the Administrator any unpaid balance of the Administrator's salary, as well as the salary for the next three calendar months following adoption of the resolution.
The Borough Administrator shall act as the chief administrative officer of the Borough of Franklin and shall be responsible to the Mayor and Council for the proper and efficient administration of the business affairs of the Borough. The duties and responsibilities shall relate to the general management of all Borough business, except those duties and responsibilities conferred upon other Borough officials by state statute, other applicable laws, rules and regulations promulgated by state and county agencies, case decision or ordinance of the Borough of Franklin. The Borough Administrator shall have the following duties:
A. 
Exercise all of the executive and administrative functions of the Borough government except as otherwise provided by state law or Borough ordinance.
B. 
Subject to and in accordance with the Borough's standard personnel policies, provide recommendations to the Borough Mayor and Council on the selection, appointment, discipline and removal of department heads.
C. 
Subject to and in accordance with the Borough's standard personnel policies and, after such consultation with the department heads as may be necessary, appoint, discipline and remove all Borough employees, other than department heads and those for whom another method of appointment or removal is provided by state law or Borough ordinance, and report such appointments, discipline and removals to the Borough Mayor and Council not later than its first meeting thereafter.
D. 
Except as otherwise provided by state law or Borough ordinance, direct the activities of department heads and all other persons employed by the Borough except the Mayor and Council.
E. 
Implement all policies formulated by the Mayor and Council.
F. 
Recommend to the Mayor and Council for adoption such measures as the Borough Administrator may deem necessary or expedient, and advise the Mayor and Council on all background matters as an aid to the establishment of policy.
G. 
Prepare and present to the Mayor and Council an annual report and such other reports as may from time to time be required on Borough affairs.
H. 
Receive and follow up on requests for information and complaints received from citizens and all manner of problems and keep the Mayor and Council informed with respect thereto.
I. 
Assure that all benefits or advantages to the Borough or its inhabitants provided for in any statute, franchise or other contract are received, and upon learning of any violation, call the same to the attention of the Mayor and Council.
J. 
Advise the Mayor and Council of all county, state and federal programs for which the Borough may qualify and which may be of benefit to the Borough or its inhabitants and, upon direction by the Mayor and Council, arrange for the preparation, execution and filing of any applications or other information which may be required for participation in such programs.
K. 
Shall prepare with the assistance of the Chief Financial Officer and submit to the Mayor and Council before the close of the fiscal year, or on such alternate date as the Mayor and Council shall determine, a proposed budget for the next fiscal year and an explanatory budget message.
L. 
Shall be responsible for the administration of the budget after its adoption by the Mayor and Council and the implementation of the work programs contained in the budget.
M. 
Shall execute and enforce the laws of the State of New Jersey and ordinances and resolutions of the Borough of Franklin as the Mayor and Council may prescribe.
N. 
Shall attend all meetings of the Mayor and Council and other committees as directed, with a right to take part in the discussion, and shall receive notice of all regular and special meetings of the Mayor and Council and all advisory committees.
O. 
Shall coordinate the preparation of all contracts with the Borough Attorney and supervise the performance and faithful execution of the same except insofar as such duties are expressly imposed upon some other Borough officer or official by statute.
P. 
Shall see that all money owed the Borough is promptly paid and that proper proceedings are taken for the security and collection of all the Borough's claims.
Q. 
In cooperation with the Chief Financial Officer, act as the Purchasing Officer of the Borough, and shall purchase, in accordance with the provisions of the governing statutes and sound purchasing practices, all supplies and equipment for the various agencies, boards, departments and other offices of the Borough of Franklin. All purchases shall be made in strict compliance with the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., or such other law as may be applicable.
R. 
Shall keep an account of all purchases and shall from time to time or when directed by the governing body make a full written report thereof. Shall also issue rules and regulations governing the requisition and purchase of all municipal supplies and equipment consistent with the provisions of this section.
S. 
Shall review and recommend all bills and vouchers for payment prior to final approval by the Mayor and Council.
T. 
Review existing municipal policies and procedures and revise and/or establish new procedures where necessary in order to make the Borough government more efficient and effective in terms of serving the residents.
U. 
Participate in the negotiation of collective bargaining contracts.
V. 
Recommend to the Mayor and Council, for adoption, such resolutions, ordinances or policies as the Administrator may deem necessary in the best interest of the Borough. Keep the Mayor and Council advised of the financial conditions of the municipality, and make reports to the Mayor and Council as requested by it.
W. 
Act as the appropriate authority responsible for the overall performance of the Police Department.
X. 
Shall have direct responsibility over the Public Works Committee.

Y. 
Perform all other duties as may be assigned by the Mayor and Council or as required by law.
