The Borough Finance Department shall include the functions of:
A. 
Chief Finance Officer.
B. 
Tax Collector.
C. 
Tax Assessor.
D. 
Borough Treasurer.
E. 
Collector of Water/Sewer Revenues.
F. 
Tax Search Officer.
G. 
Assessment Search Officer.
In accordance with P.L. 1988, c. 110, N.J.S.A. 40A:9-141 et seq., N.J.S.A. 40A:9-146 et seq., and N.J.S.A. 40A:87-15 et seq.,[1] appointment to any function of the Borough Finance Department shall be made by the Mayor with the advice and consent of the Borough Council.

A. 
The term of office for the Chief Finance Officer shall be four years, which shall run from January 1 in the year in which the chief financial officer is appointed.[1]

B. 
The term of office for the Tax Collector shall be four years, in accordance with N.J.S.A. 40A:9-142.
C. 
The term of office for the Tax Assessor shall be four years, in accordance with the provisions of N.J.S.A. 40A:9-148 et seq.
D. 
The term of office for the Borough Treasurer, Tax Search Officer, Assessment Search Officer shall be for a period of one year, in accordance with the provisions of N.J.S.A. 40A:87-15 et seq.[2]

E. 
Unless otherwise arranged by contractual obligation, the term of office for Water/Sewer Collector shall be at the pleasure of the Mayor and Council.
In accordance with the provisions of L. 1988, ch. 110, N.J.S.A. 40A:9-144 et seq., N.J.S.A. 40A:9-152 et seq., and N.J.S.A. 40A:9-151 et seq.,[1]respectively, the individuals who hold(s) the Office(s) of Chief Finance Officer, Tax Collector, Borough Treasurer and Borough Tax Assessor for a continuous period of service in accordance with the applicable statutory provisions shall continue to hold the office and shall not be removed therefrom for political or other reasons except for good cause and upon written charges filed with the Municipal Clerk and after a fair and impartial public hearing.

Any vacancies in the Department of Finance shall be filled by the governing body. Appointment to vacancies shall be made by the Mayor with the advice and consent of the Borough Council.
A. 
During the absence or disability of any duly appointed member of the Department of Finance, the Borough Council may, by resolution, appoint a regular employee of the borough to perform such duties of the absent or disabled individual during such absence or disability, provided that the individual appointed to perform said duties satisfies the statutory requirements, if any, for holding said position.
B. 
Unless otherwise arranged or agreed upon between the individual and the municipality, such absence or disability shall be limited to three months, after which time such absence or disability may be deemed a vacancy.
A. 
Members of the Borough Finance Department shall be appointed on the basis of abilities and qualifications in the field of municipal finance administration, with special training in those aspects of governmental fiscal affairs applicable to their respective offices.
B. 
The Chief Finance Officer shall satisfy the requirements for holding a Municipal Finance Officer certificate, as provided in L. 1988, c. 110.[1] In accordance with the requirements for certification, the Chief Finance Officer shall be familiar with the theory and administration of the principles of financial management, including budget preparation and control, and generally accepted accounting practices for current funds, capital funds, trust funds and utility funds.

The compensation for individual members of the Finance Department shall be provided for in the Salary Ordinance as adopted by the governing body of the borough.
A. 
In general, the Chief Finance Officer shall be responsible to the governing body for the proper and efficient management of the financial affairs of the borough, excepting therefrom those duties and responsibilities conferred upon other borough officials by state statute, other applicable laws, rules and regulations promulgated by state and county agencies, case decision or ordinance of the Borough of Franklin.
B. 
Specifically, the responsibilities of each member of the Finance Department shall be identified through the establishment of written position descriptions, adopted by resolution of the Mayor and Council and updated from time to time as deemed necessary and appropriate.
Nothing in this article shall derogate from or authorize the Chief Finance Officer or any member of the Finance Department to exercise the powers and duties of the elected and appointed officials of the Borough of Franklin.
