A. 
As used in this chapter, the following terms shall have the meanings indicated:
BOROUGH
The Borough of Oradell.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
B. 
For the purpose of this chapter, the following terms, phrases, words and their derivations shall have the meanings given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular and vice versa. The word "shall" is always mandatory and not merely directory.
It shall be unlawful for any person to cast, throw, light or fire any squib, rocket, cracker, torpedo or grenade or to explode any blank cartridge, toy pistol or cannon in which explosives are used or any other fireworks of like construction.
It shall be unlawful for any person to exhibit or have in possession with intent to give away or sell or offer for sale within the Borough of Oradell any of the articles set forth in § 125-2 or other combustible firecrackers or fireworks of any kind.
A. 
The prohibition of § 125-3 shall not apply to the sale of any such article or articles by wholesalers to each other or to merchants conducting business entirely without the Borough of Oradell or to the sale by wholesalers for public demonstrations as herein provided.
B. 
The aforesaid prohibitions shall not apply to the sale, storage or use of railroad track torpedoes or other signaling devices or to the sale, storage or use of flashlight composition by photographers or to prevent any public demonstration or display of fireworks of any kind if conducted under proper police supervision after application is made and permission is issued by the Chief of Police for such demonstration.
Any person violating any provision of this chapter shall, upon conviction thereof, be fined in an amount not exceeding $500 or be imprisoned in the county jail for a period not exceeding 90 days, or be both so fined and imprisoned.
